PROVIDER’S EMPLOYEES. The Provider shall engage and retain sufficient numbers of staff with the requisite skills knowledge, training, experience and abilities as shall be necessary for the proper performance of the Service. The Provider shall replace promptly any staff who cease to be in the employ, or under the control of the Provider for any reason or who shall be removed from assisting in the provision of the Service, and the Provider shall ensure that such replacement shall in every way be suitable for the performance of the Service. The Provider shall provide a means of identification of all staff engaged in the provision of the Service. The Provider shall operate a staff disciplinary procedure in accordance with current ACAS (Advisory, Conciliation and Arbitration Service) Code of Practice on disciplinary and grievance procedures. Where the Council has reasons to believe that any staff’s manner of performance of the Service is below the acceptable standard or detrimental to the health of the Service User or not in the best interest of the Service User: The Council may by notice in writing require the Provider to remove such staff from provision of the Service; and The Provider shall forthwith remove such staff from the provision Service and shall immediately provide a replacement unless the Council determines otherwise; The Council shall in no circumstances be liable either to the Provider or such staff in respect of any cost, expense, liability, loss or damage occasioned by such removal and the Provider shall fully indemnify the Council in respect of any claim made by such staff. The Provider shall implement and maintain a whistleblowing policy which complies with the ‘Whistleblowing Arrangements Code of Practice issued by the British Standards Institute in conjunction with Public Concern at Work’.
