Common use of Providing the Services Clause in Contracts

Providing the Services. 4.1 We will provide the Services to you from the commencement date set out in the Contract Agreement until the completion of the Services detailed. However, we will not be obliged to begin to carry out the Services until you have signed and returned the completed Contract Agreement. 4.2 We will need certain information from you which is necessary for us to provide the Services. For example, how we will gain access to the property to perform our Services, which we will discuss with you and record in writing. If you do not, after being asked by us, provide us with this information, or you provide us with incomplete or incorrect information, we may suspend the Services by giving you written notice. We will not be liable for any delay or non-performance where you have not provided this information to us after we have asked. If we suspend the Services under this clause 4.2, we reserve the right to charge you the full cost of any Service that is aborted. 4.3 If you do not pay us for the Services in accordance with clause 8.1, we may, at our discretion, suspend the Services with immediate effect until you have paid us the outstanding amounts (except where you dispute an invoice under clause 8.4). We will contact you to tell you if we intend suspending the Services, in line with our procedure (available on request). This does not affect our right to charge you interest under clause 8.3. 4.4 Services provided for House Clearance include, but are not limited to: The Removal of Items identified within the Contract Agreement, these goods are collected and removed by Removal Staff. These goods will be donated to Birmingham Hospice, to sell in order to raised funds for the Charity, or to dispose of where when they hold no economic value. The liability for the disposal of goods will pass to Birmingham Hospice upon collection of the goods.

Providing the Services. 4.1 8.1. We will deliver the Services to the address as specified in your order as soon as reasonably possible on or about the estimated delivery dates as set out in our confirmation email. The costs of delivery will be as displayed to you on our Platform. 8.2. We will provide the Services at such time and location as agreed until the subscription expires, or you end the contract as described in Clause 10 or we end the contract by written notice to you from the commencement date set out as described in the Contract Agreement until the completion Clause 12. 8.3. If our supply of the Services detailedis delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. HoweverProvided we do this, we will not be obliged liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to begin to carry out end the contract and receive a refund for any Services until you have signed and returned the completed Contract Agreementpaid for but not received. 4.2 8.4. If you do not allow us access to your property to perform the services as arranged (and you do not have a good reason for this), we may charge you additional costs incurred by us as a result. If, despite our reasonable efforts, we are unable to contact you or re-arrange access to your property we may end the contract and Clause 12.2 will apply. 8.5. We will may need certain information from you which is necessary so that we can supply the Services to you. If so, this will have been stated in the description of the Services on our Platform. We will contact you to ask for us to provide the Services. For example, how we will gain access to the property to perform our Services, which we will discuss with you and record in writingthis information. If you do not, after being asked by us, provide not give us with this informationinformation within a reasonable time of us asking for it, or if you provide give us with incomplete or incorrect information, we may suspend either end the Services by giving you written noticecontract (and Clause 12.2 will apply) or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be liable responsible for supplying the Services late or not supplying any delay part of them if this is caused by you not giving us the information, we need within a reasonable time of us asking for it. 8.6. We may have to suspend the supply of a Service to: (a) deal with technical problems or non-performance where make minor technical changes; (b) update the Service to reflect changes in relevant laws and regulatory requirements; or (c) make changes to the Service as requested by you have not provided this information or notified by us to us after you (see Clause 5). 8.7. We will contact you in advance to tell you we have askedwill be suspending supply of the Service, unless the problem is urgent or an emergency. If we have to suspend the Services under this clause 4.2Service, we reserve will adjust the right price so that you do not pay for Services while they are suspended. You may contact us to charge end the contract for a Service if we suspend it, or tell you we are going to suspend it, in each case for a period of more than two (2) months and we will refund any sums you have paid in advance for the full cost Service in respect of any Service that is abortedthe period after you end the contract. 4.3 8.8. If you do not pay us for the Services in accordance with clause 8.1when you are supposed to (see Clause 14.5) and you still do not make payment within five (5) days of us reminding you that payment is due, we may, at our discretion, may suspend supply of the Services with immediate effect until you have paid us the outstanding amounts (except where you dispute an invoice under clause 8.4)amounts.
