(ESA) recognizes The Society as the exclusive bargaining agent for All employees employed in Electrical Safety Authority, Inc., hereinafter known as ESA, in the Province of Ontario employed as supervisors, professional engineers, engineers-in-training, scientists, and professional, administrative and associated employees, save and except for persons who perform managerial functions as distinct from supervisory functions; persons employed in a confidential capacity with respect to labour relations; and persons in bargaining units for which any trade union held bargaining rights as of November 13, 1991.
