Common use of Provisioning Clause in Contracts

Provisioning. 2.4.1 BellSouth shall provision services during its regular working hours. To the extent OneTone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneTone, BellSouth will not assess OneTone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

To the extent OneTone Esodus requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneEsodus, BellSouth will not assess OneTone Esodus additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Esodus (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Esodus for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneVMT, BellSouth will not assess OneTone VMT additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone VMT (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone VMT for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneCredit Loans, BellSouth will not assess OneTone Credit Loans additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Credit Loans (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Credit Loans for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneUniversal Telecom, Inc, BellSouth will not assess OneTone Universal Telecom, Inc additional charges beyond the rates and charges specified in this Agreement. 2.4.2 2.4.1 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Universal Telecom, Inc (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Universal Telecom, Inc for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.113.3.1 (E).

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth XxxxXxxxx does not incur any overtime charges in performing the work on behalf of OneToneBCN, BellSouth XxxxXxxxx will not assess OneTone BCN additional charges beyond the rates and charges specified in this Agreement. 2.4.2 2.4.1 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone BCN (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone bill BCN for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX XxFCC No. 0 Xxxxxx1 Tariff, Xxxxxxx 13.3.1Section 13.3.1 (E).

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneXxxXxx, BellSouth will not assess OneTone XxxXxx additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone XxxXxx (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone XxxXxx for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX XxFCC No. 0 Xxxxxx1 Tariff, Xxxxxxx Section 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneRGW, BellSouth will not assess OneTone RGW additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone RGW (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone RGW for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

To the extent OneTone Tallahassee Telephone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services State E Tariff, Section E13.213.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneTallahassee Telephone, BellSouth will not assess OneTone Tallahassee Telephone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 2.4.1 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Tallahassee Telephone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Tallahassee Telephone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.113.3.1 (E).

To the extent OneTone Excel PCHP requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneExcel PCHP, BellSouth will not assess OneTone Excel PCHP additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Excel PCHP (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Excel PCHP for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

To the extent OneTone U-Dial requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneU-Dial, BellSouth will not assess OneTone U-Dial additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone U-Dial (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone bill U-Dial for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX XxFCC No. 0 Xxxxxx1 Tariff, Xxxxxxx Section 13.3.1.

To the extent OneTone Title Pawn requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneTitle Pawn, BellSouth will not assess OneTone Title Pawn additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Title Pawn (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Title Pawn for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

To the extent OneTone QuantumShift requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneQuantumShift, BellSouth will not assess OneTone QuantumShift additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone QuantumShift (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone QuantumShift for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the Version: 4Q05 Resale Standalone Agreement 02/27/06 applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneCM Tel, BellSouth will not assess OneTone CM Tel additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone CM Tel (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone CM Tel for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneSanTel, BellSouth will not assess OneTone XxxXxx additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone XxxXxx (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone XxxXxx for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX XxFCC No. 0 Xxxxxx1 Tariff, Xxxxxxx Section 13.3.1.

To the extent OneTone AllSouth Phone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneAllSouth Phone, BellSouth will not assess OneTone AllSouth Phone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone AllSouth Phone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone bill AllSouth Phone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX XxFCC No. 0 Xxxxxx1 Tariff, Xxxxxxx Section 13.3.1.

To the extent OneTone Network PTS requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneNetwork PTS, BellSouth will not assess OneTone Network PTS additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Network PTS (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Network PTS for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

To the extent OneTone M.T.G. requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneM.T.G., BellSouth will not assess OneTone M.T.G. additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone M.T.G. (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone M.T.G. for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneGo-Tel, BellSouth will not assess OneTone Go-Tel additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Go-Tel (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Go-Tel for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneTonePayless Telephone, BellSouth will not assess OneTone Payless Telephone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Payless Telephone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Payless Telephone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneEasy Telephone, BellSouth will not assess OneTone Easy Telephone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Easy Telephone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone Easy Telephone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

To the extent OneTone BudgeTel requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneBudgeTel, BellSouth will not assess OneTone BudgeTel additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone BudgeTel (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone BudgeTel for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.

Provisioning. 2.4.1 BellSouth shall provision services during its regular working hours. To the extent OneTone CloseCall requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services State E Tariff, Section E13.213.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneCloseCall, BellSouth will not assess OneTone CloseCall additional charges beyond the rates and charges specified in this Agreement. 2.4.2 2.4.1 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone CloseCall (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone CloseCall for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.113.3.1 (E).

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneQuantumShift, BellSouth will not assess OneTone QuantumShift additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone QuantumShift (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone bill QuantumShift for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the Version: 4Q05 Resale Standalone Agreement 02/27/06 applicable Maintenance of Service rates from BellSouth’s XXX XxFCC No. 0 Xxxxxx1 Tariff, Xxxxxxx Section 13.3.1.
