Common use of Provisioning Clause in Contracts

Provisioning. 2.4.1 BellSouth shall provision services during its regular working hours. To the extent Payless Telephone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless Telephone, BellSouth will not assess Payless Telephone additional charges beyond the rates and charges specified in this Agreement.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless Down Home Telephone, BellSouth will not assess Payless Down Home Telephone additional charges beyond the rates and charges specified in this Agreement.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless Easy Telephone, BellSouth will not assess Payless Easy Telephone additional charges beyond the rates and charges specified in this Agreement.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless TelephoneRent-A-Line, BellSouth will not assess Payless Telephone Rent-A- Line additional charges beyond the rates and charges specified in this Agreement.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless TelephoneU-Dial, BellSouth will not assess Payless Telephone U-Dial additional charges beyond the rates and charges specified in this Agreement.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless TelephoneHome Phone, BellSouth will not assess Payless Telephone Home Phone additional charges beyond the rates and charges specified in this Agreement.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless TelephoneEZ Communications, BellSouth will not assess Payless Telephone EZ Communications additional charges beyond the rates and charges specified in this Agreement.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of Payless TelephoneGo-Tel, BellSouth will not assess Payless Telephone Go-Tel additional charges beyond the rates and charges specified in this Agreement.
