Common use of Purpose of the Performance Test Clause in Contracts

Purpose of the Performance Test. On or about the Commercial Operation Date, the Seller performed a Performance Test in accordance with Appendix F to the Original Contract to determine the Rated Capacity as described in Section 2.02 (c) of this Agreement, and to determine the Net Plant Heat Rate as described in Section 4.02 (b) of this Agreement. Periodically throughout the Term of this Agreement, the Seller will perform additional performance tests. The purpose of this Appendix F is to provide the guidelines under which these future performance tests will be conducted.
