Pyramid Sub-Contracting and Specialist Sub-Contractors. 3.1 The parties to this Agreement have agreed that pyramid Sub-contracting is not acceptable in the Commercial and Industrial Building Industry and that reasonable steps shall be taken to prevent it from occurring. 3.2 For the purpose of this Agreement pyramid sub-contracting is defined as the practice of a sub- contractor to whom a contract is originally awarded, subletting that contract (or part thereof) to another sub-contractor. 3.3 Provided that the following circumstances are excluded from this definition, a sub-contractor may engage specialist sub-contractors to undertake portions of the works co ntained within the contractual scope of the subcontractor works provided that the works further sublet are not normally carried out by the sub-contractor’s workers. 3.4 Except by prior agreement between the principal contractor and the Unions, at no time shall the specialist sub-contractor further sublet any portions of the works for which he/she has been contracted. 3.5 Where a disagreement arises in the Plastering Industry in relation to the definition or application of the term “pyramid sub-contracting”, Clause 28.4 of the VBIA herein (Sub-Contracting Anomalies Committee) shall be observed. If the matter remains unresolved, then the parties shall refer the matter to the Disputes Board for determination. Whilst these procedures are being undertaken, no industrial action shall occur.
