Rail Demurrage. Seller shall be responsible for demurrage imposed by a railroad at the origin: (1) when the relevant railroad has been hired by Seller, or (2) when the relevant railroad has been hired by Xxxxx, Seller has received notice of the railroad’s arrival at the origin, and actions of Seller have prevented the railroad from entering the origin, resulting in the demurrage charge. Buyer shall be responsible for all other origin demurrage, as well as demurrage imposed by a railroad at destination or any other location. If a railroad charges demurrage to a Party who is not responsible for the demurrage under this Agreement, the Party responsible under this Agreement shall reimburse the Party charged by the railroad within thirty (30) days of notice from the Party charged.

Rail Demurrage. Buyer is allowed “freetime” of ten (10) consecutive calendar days after arrival of railcar at destination or after the railroad has classified the railcar as being at destination or after the railroad has classified the railcar as being on constructive placement. Freetime shall commence at 12:01 AM local time on the day following the day railcar arrives at destination. Buyer shall pay Seller, upon receipt of Seller’s invoice, a rental fee of $50 per day per railcar for each day or partial day in excess of freetime until Buyer returns the railcar to the railroad. Buyer shall also pay Seller upon receipt of Seller’s invoice, for any demurrage or storage charges levied by any third party transportation company as a result of Buyer not returning railcars to railroad within said freetime.

  • Demurrage If as a result of the Customer's actions and unless permission is granted by the Company, if the Equipment is not returned during or at the end of the term, then for every hour, or portion thereof, from the end of the term to the time when the Equipment is returned to the Company, as required herein, the Customer shall pay a rental rate equal to three (3) times (x) the standard hourly rental rate for such equipment.

  • Freight All quotes to Members shall provide a line item for cost for freight or shipping regardless if there is a charge or not. If no charge for freight or shipping, indicate by stating “No Charge”, “$0”, “included in price” or other similar indication. Otherwise, all shipping, freight or delivery changes shall be passed through to the TIPS Member at cost with no markup and said charges shall be agreed by the TIPS Member unless alternative shipping terms are agreed by TIPS as a result of the proposal award. All new supplies equipment and services shall include manufacturer's minimum standard warranty unless otherwise agreed to in writing. Vendor shall be legally permitted to sell all products offered for sale to TIPS Members if the offering is included in the Request for Proposal (“RFP”) category. All goods proposed and sold shall be new unless clearly stated in writing. The Vendor shall provide timely and accurate customer support for orders to TIPS Members as agreed by the Parties. Vendors shall respond to such requests within a commercially reasonable time after receipt of the request. If support and/or training is a line item sold or packaged with a sale, support shall be as agreed with the TIPS Member.

  • Transport The Parents consent to the Pupil travelling by any form of public transport and / or in a motor vehicle driven by a responsible adult who is duly licensed and insured to drive a vehicle of that type.

  • Interconnection Customer Provided Services The services provided by Interconnection Customer under this LGIA are set forth in Article 9.6 and Article 13.5. 1. Interconnection Customer shall be paid for such services in accordance with Article 11.6.

  • Flextime ‌ (a) For the purpose of this agreement, flextime means the hours worked by an employee, or group of employees, who are given authority by the Employer to: (1) choose their starting and finishing times; and (2) choose their length of workday within a stated maximum number of hours, subject to meeting the required annual hours of work in accordance with this agreement, through a specified averaging period. (b) The full-time employee on flextime who has a day of absence, whether with or without pay, will be deemed to be absent for the agreed upon hours, providing at least the agreed upon hours are required to complete the averaging period. If less than the agreed upon hours are required to complete the averaging period, such number of hours will be deemed to be the hours of absence. (c) The averaging period for employees on flextime will be two pay periods. (d) The workday for those employees on flextime will not exceed 10 hours.

  • Interconnection Customer (1) Interconnection Customer shall construct and, unless otherwise indicated, shall own, the following Interconnection Facilities: None (2) In the event that, in accordance with the Interconnection Construction Service Agreement, Interconnection Customer has exercised the Option to Build, it is hereby permitted to build in accordance with and subject to the conditions and limitations set forth in that Section, the following portions of the Transmission Owner Interconnection Facilities which constitute or are part of the Customer Facility: None Ownership of the facilities built by Interconnection Customer pursuant to the Option to Build shall be as provided in the Interconnection Construction Service Agreement.
