Random Alcohol Test, First Time Positive Test. A. An employee required to possess a CDL who is selected for a random alcohol test and tests at a level at 0.02 or greater blood alcohol concentration is considered to have tested “positive” for alcohol and shall be immediately removed from work for a period of twenty-four (24) hours. An employee required to possess a CDL, shall not have been considered to have provided a “positive” sample, until a second test as provided in the regulations, has confirmed a blood alcohol percentage at the statutory level.
