Supplier will not be paid for this Milk as it has tested positive for antibiotics and is deemed to be in breach of ACM Food Safety Program (see part 6.1 for details) and Milk Quality Standards (see Table 3.1). For all positive samples (vat or Tanker) Milk collection will be suspended until a negative sample is achieved. Any subsequent positive vat samples taken during this process will not be paid for. Only after a negative sample is achieved, will ACM schedule Milk for collection. Supplier will be required to complete a CAR (Corrective Action Report) which is a requirement of ACM’s Food Safety Program. Refer to section 4.3 Management of Non‐Conformance ‐ Incident Report in the ACM Food Safety Program manual.

Upon customer risk assessment , milk is REJECTED AND DEEMED UNFIT FOR HUMAN CONSUMPTION Supplier will not be paid for this Milk as it has tested positive for antibiotics and is deemed to be in breach of ACM Food Safety Program (see 6.1 for details) and Milk Quality Standards (see Table 3.1). Milk collection will be suspended until a negative vat sample is obtained. Any subsequent positive vat samples taken during this process will not be paid for. Only after a negative sample is achieved, will ACM schedule Milk for collection. In addition, Supplier will be held responsible for costs and expenses incurred by ACM as a result of the positive screening, including but not limited to: − The total cost of all Milk in the Tanker at the current value of the Milk, including Milk collected from other Suppliers; − Any additional freight costs (eg, Farm to disposal site); and − Any applicable disposal costs – (eg, handling of this Milk by EPA approved facilities). A Recipient Created Tax Invoice (RCTI) Credit Note will be raised for the disposal cost and amount owing will be deducted from Supplier’s Milk payment over a 3-month period (or such other period to be determined by ACM acting reasonably). In any case where a Tanker load of Milk has been rejected, ACM is required to notify Dairy Food Safety Victoria of the residue detection within five business days of the initial detection with trace forward details (Part A Tanker). Trace back details (Part B Supplier) will be reported within ten business days of the incident. Supplier will be required to complete a CAR (Corrective Action Report) which is a requirement of ACM’s Food Safety Program. Positive Test. RESULTS FOR ANTIBIOTICS AFTER MILK IS COLLECTED AND HAS CAUSED THE
Positive Test. Drug test with a verified presence of the identified drug or its metabolite at or above the minimum levels specified in 49 CFR Part 40, as amended. A positive alcohol test result means a confirmed alcohol concentration of 0.04 BAC, or greater.
Positive Test. The employee shall be given the option to either immediately:
1. voluntarily resign his/her employment with the BOARD; or
2. be placed on sick leave, if available, or a voluntary leave of absence, without pay, during which the employee must immediately enter a BOARD-approved alcohol or drug treatment program. An employee exercising this option shall remain on sick leave or unpaid medical leave of absence only while remaining an active cooperating patient in the program, as certified by the medical facility supervising the program, and may not return to active working status until he/she has been released to return to work by such medical facility and has been retested with a negative test result and certified by the medical facility as fully capable of performing the duties of an employee in a safe manner. Any employee who exercises this option who is either removed from the program by the medical facility supervising the program or who withdraws from the program before being released to return to work by such medical facility shall be deemed to have resigned his/her employment with the BOARD. An employee who completes the program who is released to return to work, who tests negative before returning to work and who returns to active working status, shall be subject to retesting.
3. In the event the employee refuses to exercise either of the options specified above in (1) or (2), the employee shall be subject to immediate discharge.

Positive Test. (1) First time.
(a) The member shall be referred to the City’s Employee Assistance Program (EAP).
(b) There shall be no discipline if the member successfully completes all EAP recommendations.
(c) A member's failure to participate in or complete the counseling and rehabilitation program may be grounds for discipline.
(d) A member may be disciplined for separate concurrent violation(s) of rules, directives, etc., notwithstanding the drug test results.
(e) A member shall be subject to follow-up testing for a period of two (2) years after the member's completion of counseling, treatment and/or aftercare.
Positive Test. In the first instance of a positive test (0.04 or greater), the employee shall be sent home and recorded in a no pay status for the balance of the day. Effective the next day, the employee shall be suspended without pay for five (5) workdays. The employee must successfully complete any program as identified, if required, by the Substance Abuse Professional and/or Medical Review Officer as well as pass a return to duty test before being permitted to return to work. Second positive test: In the second instance of a positive test (0.04 or greater), the employee shall be sent home and recorded in a no pay status for the balance of the day. Effective the next day, the employee shall be suspended without pay for ten
Positive Test. Result An employee whose confirmation alcohol or drug test is a "positive test" will be considered in violation of the BOARD's Rules and Regulations. The initial test will be considered only as a test to determine whether there is a possibility of the presence of alcohol or drugs in the employee's system. It is recognized that this test is not a reliable indicator and that individuals can test positive on this test and have no such substances in their system. For this reason, results of the initial test will not be placed in an employee's personnel file and no record of the positive reading on the initial test will be maintained. However, when a positive reading on the initial test is recorded, the confirmation test will be rerun. A "positive test" for alcohol or an illegal drug means to have the presence of alcohol, an illegal drug and/or a drug metabolite in the employee's system, as determined by appropriate testing of a bodily specimen, that is equal to or greater than the levels specified in the Ohio Administrative Code, Ohio Revised Code, United States Code, and/or United States Department of Transportation Regulations. "Illegal drug (or drug)" means a controlled substance as defined by Section 802(6) of Title 21 of the United States Code, the possession of which is unlawful under Chapter 13 of that Title. The term "illegal drugs" does not mean the use of a controlled substance pursuant to a valid prescription or other uses authorized by law.
Positive Test. The Department of Transportation standards shall be used to determine threshold limits for a positive drug and/or alcohol test.
