Common use of Receipt of File Clause in Contracts

Receipt of File. Member agrees that Member shall be solely liable for, and Nusenda shall not have any liability whatsoever to Member for, any File or the Images or other information contained therein that are not received by Nusenda or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member agrees that Nusenda has no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Member. Nusenda has no obligation to notify Member of the rejection of a File or the Images or other information contained therein. Nusenda shall have no liability to Member for the rejection of a File or the Images or other information contained therein or for the failure to notify Member of such rejection. Upon receipt of a File submitted by Member, Nusenda may examine such File and the Images and other information contained therein to ensure that Member has complied with this Agreement and followed the Procedures. If Nusenda determines that Member has not complied with this Agreement or followed the Procedures or if errors exist in the Images or other information contained in the File, Nusenda, in its sole discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda may credit Member’s Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda may, at its option, also perform a risk management analysis of one or more Files submitted by Member to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda determines that Member has complied with this Agreement and processed and transmitted the File in accordance herewith and with the Procedures, the File is balanced and the Images meet the requirements of Section 6 of this Agreement, then Nusenda shall accept the File (an “Accepted File”) for deposit to Member’s Account.. Information and data reported hereunder: (a) may be received prior to final posting and confirmation and is subject to correction and (b) is for informational purposes only and may not be relied upon. Member agrees that Nusenda shall have no liability for the content of payment-related information. Notwithstanding the fact that Nusenda has accepted a File for deposit, any credit made to Member’s Account shall be provisional, and Member shall remain liable to Nusenda for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, Nusenda.

Receipt of File. Member agrees You agree that Nusenda Credit Union has no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Memberyou. Nusenda has no obligation to The Credit Union will notify Member you of the rejection of a File File, either in writing or via email, of the Images or other information contained therein. Nusenda The Credit Union shall have no liability to Member you for the rejection of a File or the Images or other information contained therein or for the failure to notify Member you of such rejection. Upon receipt of a File submitted by Memberyou, Nusenda the Credit Union may examine such File and the Images and other information contained therein to ensure that Member has you have complied with this Agreement and followed the Proceduresinstructions. If Nusenda Credit Union determines that Member has you have not complied with this Agreement or followed the Procedures instructions or if errors exist in the Images or other information contained in the File, NusendaCredit Union, in its sole discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda the Credit Union may credit Member’s your Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda Credit Union may, at its option, also perform a risk management analysis of one or more my Files submitted by Member you to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda the Credit Union may reject any such File File, or the Images images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda the Credit Union determines that Member has you have complied with this Agreement and processed and transmitted the File in accordance herewith and with the Proceduresinstructions, the File is balanced and the Images meet the requirements of Section 6 Sections 4 and 7 of this Agreement, then Nusenda the Credit Union shall accept the File (an “Accepted File”) for deposit to Member’s your Account.. Information . Upon acceptance of the File, Credit Union shall electronically notify you of receipt and data reported hereunder: (a) may be received prior to final posting and confirmation and is subject to correction and (b) is acceptance of the Accepted File for informational purposes only and may not be relied upondeposit. Member agrees that Nusenda shall have no liability for the content of payment-related information. Notwithstanding Notwithstanding, the fact that Nusenda the Credit Union has accepted a File for deposit, any credit made to Member’s your Account shall be provisional, and Member you shall remain liable to Nusenda Credit Union for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, Nusendathe Credit Union.

Receipt of File. Member Customer agrees that Member Customer shall be solely liable for, and Nusenda Bank shall not have any liability whatsoever to Member Customer for, any File or the Images or other information contained therein that are not received by Nusenda Bank or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member Customer agrees that Nusenda Bank has no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by MemberCustomer. Nusenda Bank has no obligation to notify Member Customer of the rejection of a File or the Images or other information contained therein. Nusenda Bank shall have no liability to Member Customer for the rejection of a File or the Images or other information contained therein or for the failure to notify Member Customer of such rejection. Upon receipt of a File submitted by MemberCustomer, Nusenda Bank may examine such File and the Images and other information contained therein to ensure that Member Customer has complied with this Agreement Section Four and followed the Procedures. If Nusenda Bank determines that Member Customer has not complied with this Agreement Section Four or followed the Procedures or if errors exist in the Images or other information contained in the File, NusendaBank, in its sole discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda Bank may credit MemberCustomer’s Designated Account for the full amount of the deposit and make any necessary adjustments to the Designated Account to correct the error. Nusenda Bank may, at its option, also perform a risk management analysis of one or more Files submitted by Member Customer to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda Bank may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda Bank determines that Member Customer has complied with this Agreement Section Four and processed and transmitted the File in accordance herewith and with the Procedures, the File is balanced and the Images meet the requirements of Section 6 of this AgreementPart II, subsection 4.5, then Nusenda Bank shall accept the File (an “Accepted File”) for deposit to MemberCustomer’s Designated Account.. Information . Upon acceptance of the File, Bank shall electronically notify Customer of receipt and data reported hereunder: (a) may be received prior to final posting and confirmation and is subject to correction and (b) is acceptance of the Accepted File for informational purposes only and may not be relied upon. Member agrees that Nusenda shall have no liability for the content of payment-related informationdeposit. Notwithstanding the fact that Nusenda Bank has accepted a File for deposit, any credit made to MemberCustomer’s Designated Account shall be provisional, and Member Customer shall remain liable to Nusenda Bank for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, Nusendaagainst Bank.

Receipt of File. Member agrees that Member shall be solely liable for, and Nusenda Ent shall not have any liability whatsoever to Member for, any File or the Images or other information contained therein that are not received by Nusenda Ent or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member agrees that Nusenda Ent has no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Member. Nusenda has no obligation to notify Member of the rejection of a File or the Images or other information contained therein. Nusenda Ent shall have no liability to Member for the rejection of a File or the Images or other information contained therein or for the failure to notify Member of such rejection. Upon receipt of a File submitted by Member, Nusenda Ent may examine such File and the Images and other information contained therein to ensure that Member has complied with this Agreement and followed the Procedures. If Nusenda Ent determines that Member has not complied with this Agreement or followed the Procedures or if errors exist in the Images or other information contained in the File, NusendaEnt, in its sole discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda Ent may credit Member’s Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda Ent may, at its option, also perform a risk management analysis of one or more Files submitted by Member to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda Ent may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda Ent determines that Member has complied with this Agreement and processed and transmitted the File in accordance herewith and with the Procedures, the File is balanced and the Images meet the requirements of Section 6 of this Agreement, then Nusenda Ent shall accept the File (an “Accepted File”) for deposit to Member’s Account.. . Upon acceptance of the File, Ent shall electronically notify Member of receipt and acceptance of the Accepted File for deposit. Information and data reported hereunder: (a) may be received prior to final posting and confirmation and is subject to correction and (b) is for informational purposes only and may not be relied upon. Member agrees that Nusenda Ent shall have no liability for the content of payment-related information. Notwithstanding the fact that Nusenda Ent has accepted a File for deposit, any credit made to Member’s Account shall be provisional, and Member shall remain liable to Nusenda Ent for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, NusendaEnt.

Receipt of File. Member agrees To ensure accuracy, you shall balance the dollar amount of each deposit to the sum of the Checks prior to transmitting the File in accordance with the Procedures. You may send multiple Files to us throughout the day. If the number of Checks in or the total dollar value of the Files sent by you to us on any day exceeds the deposit limit that Member may be established for you by us, we may, at our option, refuse to accept the File that exceeds the deposit limit, or we may accept and process the File. You agree that you shall be solely liable for, and Nusenda we shall not have any liability whatsoever to Member you for, any File or the Images or other information contained therein that are not received by Nusenda us or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member agrees You agree that Nusenda has we have no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Memberyou. Nusenda has We will endeavor to notify you but have no obligation to notify Member you of the rejection of a File or the Images or other information contained therein. Nusenda We shall have no liability to Member you for the rejection of a File or the Images or other information contained therein or for the failure to notify Member you of such rejection. Upon receipt of a File submitted by Memberyou, Nusenda we may examine such File and the Images and other information contained therein to ensure that Member has you have complied with this Agreement Service Description and followed the Procedures. If Nusenda determines we determine that Member has you have not complied with this Agreement Service Description or followed the Procedures or if errors exist in the Images or other information contained in the File, Nusenda, we may in its sole our discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda we may credit Member’s your Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda We may, at its our option, also perform a risk management analysis of one or more Files submitted by Member you to detect potentially fraudulent Checks, and, in its our sole discretion, Nusenda we may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda determines that Member has complied with this Agreement and processed and transmitted the File in accordance herewith and with the Procedures, the File is balanced and the Images meet the requirements of Section 6 of this Agreement, then Nusenda shall accept the File (an “Accepted File”) for deposit to Member’s Account.. Member agrees that Nusenda AMHFCU has no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Member. Nusenda AMHFCU has no obligation to notify Member of the rejection of a File or the Images or other information contained therein. Nusenda AMHFCU shall have no liability to Member for the rejection of a File or the Images or other information contained therein or for the failure to notify Member of such rejection. Upon receipt of a File submitted by Member, Nusenda AMHFCU may examine such File and the Images and other information contained therein to ensure that Member has complied with this Agreement and followed the Procedures. If Nusenda AMHFCU determines that Member has not complied with this Agreement or followed the Procedures or if errors exist in the Images or other information contained in the File, NusendaAMHFCU, in its sole discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “"Corrected File”"). As a form of correction, Nusenda AMHFCU may credit Member’s 's Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda AMHFCU may, at its option, also perform a risk management analysis of one or more Files submitted by Member to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda AMHFCU may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda AMHFCU determines that Member has complied with this Agreement and processed and transmitted the File in accordance herewith and with the Procedures, the File is balanced and the Images meet the requirements of Section 6 of this Agreement, then Nusenda AMHFCU shall accept the File (an “"Accepted File”") for deposit to Member’s 's Account.. . Upon acceptance of the File, AMHFCU shall electronically notify Member of receipt and acceptance of the Accepted File for deposit via the provisional posting to their Account. Information and data reported hereunder: (a) may be received prior to final posting and confirmation and is subject to correction and (b) is for informational purposes only and may not be relied upon. Member agrees that Nusenda AMHFCU shall have no liability for the content of payment-related information. Notwithstanding the fact that Nusenda AMHFCU has accepted a File for deposit, any credit made to Member’s 's Account shall be provisional, and Member shall remain liable to Nusenda AMHFCU for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, NusendaAMHFCU.

Receipt of File. If Nusenda AMHFCU determines that Member has not complied with this Agreement or followed the Procedures or if errors exist in the Images or other information contained in the File, NusendaAMHFCU, in its sole discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda AMHFCU may credit Member’s Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda AMHFCU may, at its option, also perform a risk management analysis of one or more Files submitted by Member to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda AMHFCU may reject any such File or the Images or other information contained therein. Member agrees that Nusenda AMHFCU shall have no liability for the content of payment-related information. Notwithstanding the fact that Nusenda AMHFCU has accepted a File for deposit, any credit made to Member’s Account shall be provisional, and Member shall remain liable to Nusenda AMHFCU for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, NusendaAMHFCU.

Member agrees You agree that Member you shall be solely liable for, and Nusenda neither Bank nor Xxxxxxx shall not have any liability whatsoever to Member for, you for any File or the Images or other information contained therein that are not received by Nusenda us or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member agrees You agree that Nusenda neither Bank nor Xxxxxxx has no an obligation to accept a File for remote deposit and, therefore, may reject any File or the Images or other information contained therein submitted by Memberyou. Nusenda has Except as otherwise required by applicable law, we have no obligation to notify Member you of the rejection of a File or the Images or other information contained therein. Nusenda , and neither Bank nor Alviere shall have no any liability to Member you for the rejection of a File or the Images or other information contained therein or for the failure to notify Member you of such rejection. Upon receipt of a File submitted by Memberyou, Nusenda Bank and/or Alviere may examine such File and the Images and other information contained therein to ensure that Member has you have complied with this Agreement and followed the ProceduresAgreement. If Nusenda determines that Member has Bank or Alviere determine you have not complied with this Agreement or followed the Procedures or if errors exist in the Images or other information contained in the File, Nusenda, in its sole discretion, Bank or Alviere may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda your Account may credit Member’s Account be credited for the full amount of the deposit and we may make any necessary adjustments to the Account to correct the error. Nusenda may, at its option, also perform a risk management analysis of one or more Files submitted by Member to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda determines we determine that Member has you have complied with this Agreement and processed and transmitted the File in accordance herewith and with the Proceduresthis Agreement, the File is balanced and the Images meet the requirements of Section 6 of this Agreement, then Nusenda we shall accept the File (an “Accepted File”) for deposit to Member’s your Account.. Upon acceptance of the File, we shall electronically notify you of receipt and data reported hereunder: (a) may be received prior to final posting and confirmation and is subject to correction and (b) is acceptance of the accepted File for informational purposes only and may not be relied upon. Member agrees that Nusenda shall have no liability for the content of payment-related informationdeposit. Notwithstanding the fact that Nusenda has we have accepted a File for deposit, any credit made to Member’s your Account shall be provisionalbe, and Member you shall remain liable to Nusenda us for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, NusendaBank and/or Alviere.

Receipt of File. Member agrees that Member shall be solely liable for, and Nusenda HFCU shall not have any liability whatsoever to Member for, any File or the Images or other information contained therein that are not received by Nusenda HFCU or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member agrees that Nusenda HFCU has no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Member. Nusenda HFCU has no obligation to notify Member of the rejection of a File or the Images or other information contained therein. Nusenda HFCU shall have no liability to Member for the rejection of a File or the Images or other information contained therein or for the failure to notify Member of such rejection. Upon receipt of a File submitted by Member, Nusenda HFCU may examine such File and the Images and other information contained therein to ensure that Member has complied with this Agreement and followed the Procedures. If Nusenda HFCU determines that Member has not complied with this Agreement or followed the Procedures or if errors exist in the Images or other information contained in the File, NusendaHFCU, in its sole discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda HFCU may credit Member’s Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda HFCU may, at its option, also perform a risk management analysis of one or more Files submitted by Member to detect potentially fraudulent Checks, and, in its sole discretion, Nusenda HFCU may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda HFCU determines that Member has complied with this Agreement and processed and transmitted the File in accordance herewith and with the Procedures, the File is balanced and the Images meet the requirements of Section 6 of this Agreement, then Nusenda HFCU shall accept the File (an “Accepted File”) for deposit to Member’s Account.. . Upon acceptance of the File, HFCU shall electronically notify Member of receipt and acceptance of the Accepted File for deposit. Information and data reported hereunder: (a) may be received prior to final posting and confirmation and is subject to correction and (b) is for informational purposes only and may not be relied upon. Member agrees that Nusenda HFCU shall have no liability for the content of payment-related information. Notwithstanding the fact that Nusenda HFCU has accepted a File for deposit, any credit made to Member’s Account shall be provisional, and Member shall remain liable to Nusenda HFCU for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, NusendaHFCU.

Receipt of File. Member agrees that Member shall be solely liable for, and Nusenda evolve FCU shall not have any liability whatsoever to Member for, any File or the Images or other information contained therein that are not received by Nusenda evolve FCU or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member agrees that Nusenda evolve FCU has no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Member. Nusenda evolve FCU has no obligation to notify Member of the rejection of a File or the Images or other information contained therein. Nusenda evolve FCU shall have no liability to Member for the rejection of a File or the Images or other information contained therein or for the failure to notify Member of such rejection. Upon receipt of a File submitted by Member, Nusenda evolve FCU may examine such File and the Images and other information contained therein to ensure that Member has complied with this Agreement and followed the Procedures. Notwithstanding the fact that Nusenda evolve FCU has accepted a File for deposit, any credit made to Member’s Account shall be provisional, and Member shall remain liable to Nusenda evolve FCU for any errors, inaccuracies, breach of warranties and any other loss sustained by, or claim made against, Nusendaevolve FCU.

Receipt of File. Member agrees You may send multiple Files to us throughout the day. You agree that Member we may apply unique business rules to your Files and the transactions within your Files that differ substantially from the established business rules for your lockbox. If such unique business rules are used, we will notify you orally or in writing, and we may modify these unique rules as we deem necessary. If the number of Checks in or the total dollar value of the Files sent by you to us on any day exceeds the deposit limit that may be established for you by us, we may, at our option, refuse to accept the File that exceeds the deposit limit, or we may accept and process the File. You agree that you shall be solely liable for, and Nusenda we shall not have any liability whatsoever to Member you for, any File or the Images or other information contained therein that are not received by Nusenda us or for any File or the Images or other information contained therein that are intercepted or altered by an unauthorized third party. Member agrees You agree that Nusenda has we have no obligation to accept a File and, therefore, may reject any File or the Images or other information contained therein submitted by Memberyou. Nusenda has We will endeavor to notify you but have no obligation to notify Member you of the rejection of a File or the Images or other information contained therein. Nusenda We shall have no liability to Member you for the rejection of a File or the Images or other information contained therein or for the failure to notify Member you of such rejection. Upon receipt of a File submitted by Memberyou, Nusenda we may examine such File and the Images and other information contained therein to ensure that Member has you have complied with this Agreement Service Description and followed the Procedures. If Nusenda determines we determine that Member has you have not complied with this Agreement Service Description or followed the Procedures or if errors exist in the Images or other information contained in the File, Nusenda, we may in its sole our discretion, may either reject the File or elect to correct the error and accept and process the corrected File (a “Corrected File”). As a form of correction, Nusenda we may credit Member’s your Account for the full amount of the deposit and make any necessary adjustments to the Account to correct the error. Nusenda As a form of correction, we may apply business rules to your File and to the transactions within your File that may vary from the established business rules for your lockbox. You shall be solely responsible for any corrections, adjustments or notifications that may be required as a result of corrections we make. We may, at its our option, also perform a risk management analysis of one or more Files submitted by Member you to detect potentially fraudulent Checks, and, in its our sole discretion, Nusenda we may reject any such File or the Images or other information contained therein. If after examination of a File and the Images and other information contained therein, Nusenda determines that Member has complied with this Agreement and processed and transmitted the File in accordance herewith and with the Procedures, the File is balanced and the Images meet the requirements of Section 6 of this Agreement, then Nusenda shall accept the File (an “Accepted File”) for deposit to Member’s Account..
