Recording of Events. Caterer agrees that audio or video recording of the event by Caterer’s employees, assigns, or any other individual affiliated with Caterer, shall be prohibited without the prior written consent of the parties to the Agreement. University reserves the right to record the event for archival purposes only and not for sale or commercial use.

The Caterer will ensure that no audio or visual recording of the event shall be made without the prior mutual written consent of the parties to the Agreement provided that University reserves the right to record the event for archival purposes only and not for sale or commercial use.

I understand that these Events will be filmed and/or recorded for further use by ROS, including to promote its programs and services (“advertisements”), and I consent to the use of my photograph, image, voice and likeness in advertisements, and in other uses by ROS, in any and all media, throughout the universe, in perpetuity, without remuneration.

All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the laws of the State of New York. I have read the preceding Agreement carefully. I am agreeing to abide by the terms of this Agreement, which includes a waiver and release of liability. This confirms my 2023- 2024 ROCHESTER ORATORIO SOCIETY, INC. registration for all Rehearsals and Event(s) in which I participate. Signature: Date
