Records Retention and Use. Records of a positive drug or alcohol test or refusal to submit to such test as provided in this Article 27 shall be maintained for a period of six (6) years from the date of the incident which gave rise to the positive test or refusal, so long as there is no subsequent positive test, refusal to submit to a test or failure to comply with rehabilitation program requirements referenced in Section 27.9. All such records shall not be utilized for any purpose after four (4) years from the date of the incident which gave rise to the positive test or refusal, so long as there is no subsequent positive test, refusal to submit to a test or failure to comply with rehabilitation program requirements referenced in Section 27.9.
