Recovery Schedules. 6.5.7.1. The Contractor’s refusal, failure or neglect to take appropriate recovery action or to submit a Recovery Schedule shall constitute reasonable evidence that the Contractor is not prosecuting the Work with the diligence that will ensure its completion within the applicable Contract Time. Such lack of action shall constitute sufficient basis for the Construction Manager to withhold payments to the Contractor.
