Redundancy and Recall. 22.01 Teachers without an assignment on August 1st will be declared redundant and notified by email, which will be copied to the local OECTA President. The Superintendent of Human Resource Services or designate shall notify the affected teacher(s) and in writing within 5 days of the Board’s decision stating reasons necessary for the redundancy, with a copy to the local Executive of the OECTA. Redundant teachers shall be placed on the Recall List. The Board shall recall any teacher declared redundant to a permanent assignment as follows:
a) Between August 16th and August 31st, any available teaching assignments shall be offered to redundant teachers beginning with the most senior teacher who holds qualifications as per the Education Act. In the event that all redundant teachers reject their assignment(s) so offered, the Board shall fill such assignment(s) beginning with the least senior redundant teacher who holds qualifications as per the Education Act.
i) If the least senior redundant teacher is assigned in accordance with a) above, and still rejects the assignment, he/she will be deemed to have forfeited his/her right of recall and shall be removed from the recall list.
b) From September 1st to 30th, when a new assignment becomes available, the most senior teacher who holds qualifications as per the Education Act on the recall list, shall be recalled to permanent status. If the teacher being recalled has been previously assigned to an LTO assignment, in order to minimize disruption to the system, it shall be the Board’s prerogative as to whether that teacher remains in the LTO assignment or is reassigned to a new assignment. Teachers recalled between September 1st and 30th shall be eligible for extended health care and dental coverage effective September 1. Experience and accrued sick leave will be acknowledged as if there had been no break in service. The following benefits will take effect on the recall date: Life, Accidental Death & Dismemberment (A.D.D.), Long Term Disabillity (L.T.D.)
c) After September 30th as permanent assignments become available, the most senior teacher, who holds qualifications as per the Education Act, on the recall list shall be recalled to permanent status. Teachers recalled after September 30th shall be considered as having been recalled from a lay off and their seniority shall be determined as per Article 19. Benefits entitlement as per Article 8 will take effect on the recall date. Sick leave accrual to date of layoff will be recognized.
d) All offers of recall shall be made by e-mail to the teacher and copied to the local OECTA Unit. The teacher so offered shall respond within twenty-four (24) hours. A teacher who fails to respond within the twenty-four (24) hours, shall be deemed to have forfeited his/her recall rights and their name shall be removed from the recall list.
20.03 a) A redundant teacher who is offered a position with an FTE which is less than the assignment he/she held in the preceding June, shall have the right to refuse the assignment while maintaining his/her position on the recall list. In the event that all redundant teachers reject the lower FTE assignment(s) so offered, the Board shall fill the assignment(s) beginning with the least senior redundant teacher who holds qualifications as per the Education Act. Where possible, a teacher placed in this manner shall be given an additional LTO assignment up to an FTE workload equivalent to that held by that teacher in the preceeding June.

Redundancy and Recall. 22.01 Teachers without an assignment on August 1st It is the intent of the surplus and redundancy procedures to declare redundant the teachers with the least seniority provided that in all cases the teachers remaining in the system are qualified and capable of teaching the subjects of the program. When a teacher who has completed the required probationary period is declared surplus and eligible for transfer, and no other position for which the teacher is qualified is available in the elementary panel, the teacher will be assigned to a surplus pool, if a position in such pool is available in accordance with Article 30.02 (c), for a period of one (1) school year. The resulting vacant position in the following Round 1.
22.02 a) In the event that it becomes necessary surplus pool shall be filled for the Board to declare a remainder of the school year by the most senior teacher redundant on the recall list who had completed the probationary period at the time of placement on the recall list. Where no teacher on the recall list had completed the probationary period at the time of placement on the recall list, no teacher will move to the systemsurplus pool. By May 31, all teachers whose employment is to be terminated at the end of the school year will be notified in writing by the Director or designate and this notification will clearly state that teacher the termination is for reasons of redundancy. A list of names of teachers so affected shall be laid off effective August 31stgiven to the Union Local President at the same time it is furnished to the trustees. A teacher in the surplus pool will receive all salary, benefits, experience and seniority as if they were assigned a regular teaching position. Teachers in the surplus pool will be assigned work by the Director or designate. The Superintendent of Human Resource Services or designate shall notify the affected teacher(s) and OECTA. Redundant teachers shall be placed on included in their former school's complement for the Recall List.purpose of staff allocation in accordance with Article 29.01 (a)
