Common use of Reimbursement of the FCRHA Clause in Contracts

Reimbursement of the FCRHA. All reasonable sums paid by the FCRHA and all reasonable costs and expenses incurred by the FCRHA in connection with its performance of any obligation pursuant to Section 20.02, together with interest thereon at the Involuntary Rate from the respective dates of the FCRHA’s making of each such payment or incurring of each such sum, cost, expense, charge, payment or deposit until the date of actual repayment to the FCRHA, shall be paid by Tenant to the FCRHA within ten (10) Business Days after the FCRHA shall have submitted to Tenant a statement, in reasonable detail, substantiating the amount demanded by the FCRHA. Any payment or performance by the FCRHA pursuant to Section 20.02 shall not be nor be deemed to be a waiver or release of breach or Event of Default of Tenant with respect thereto or of the right of the FCRHA to terminate this Lease, institute summary proceedings or take such other action as may be permissible hereunder if an Event of Default by Tenant shall have occurred. The FCRHA shall not be limited in the proof of any damages which the FCRHA may claim against Tenant arising out of or by reason of Tenant’s failure to provide and keep insurance in force as aforesaid to the amount of the insurance premium or premiums not paid, but the FCRHA also shall be entitled to recover, as damages for such breach, the uninsured amount of any loss and damage and the reasonable costs and expenses of suit, including, without limitation, reasonable attorneys’ fees and disbursements, suffered or incurred by reason of an uninsured damage to or destruction of the Premises. If as a result of such dispute resolution it is determined that Tenant was complying with the terms of this Lease regarding the maintenance and repair of the Premises, then the FCRHA shall not be entitled to reimbursement for any work they may have performed.
