Common use of Release Following Promotion Clause in Contracts

Release Following Promotion. Any employee released during the probationary period following promotion shall be reinstated to the employee’s former position or a position in the class from which the employee promoted, unless the reason for release is cause for dismissal. An employee so reinstated shall be placed at a salary step in the position formerly held consistent with the provisions of the Salary Administration Section of this Memorandum of Understanding. In no event shall an employee so reinstated be placed at a salary step lower than the step held prior to promotion. If no vacancy exists in this class, the employee with the least amount of time in this class shall be demoted to the most recent class in which the employee has satisfactorily served. If any employee is caused to be released by such action, such employee shall be placed on a reemployment register for the classification from which the employee is released. Any employee who is released during a probationary period following promotion shall retain appeal rights to dismissal from the City, but not the right to appeal the employee’s release from the position from which the employee was demoted.
