Release of this document. (a) If the City is satisfied that the Developer has provided all Public Benefits and otherwise complied with this document then the City must promptly do all things reasonably required to remove this document from the title to the Land. (b) If the Developer registers a plan of strata Subdivision in respect of the Land, in accordance with the requirements of this document, the City must promptly do all things reasonably required to remove this document from the title to allotments within the strata plan that are not: (i) the common property of the strata plan; or (ii) allotments required under this document to be developed as: (A) Affordable Housing Units; or (B) Car Park Lots.
Release of this document. (a) The City agrees to do all things reasonably required by the Developer to, promptly following a request by the Developer: (i) release and discharge this document with respect to the Land or a part of the Land forming the subject of the request if the request concerns a strata lot forming part of the Land; and (ii) execute the relevant documents to enable the Developer to remove the notation of this document from title to the Land or relevant part of the Land forming the subject of the request, if the City is satisfied that the Developer has provided all Public Benefits in relation to the Land or all the relevant Public Benefits in relation to a strata lot forming part of the Land and is not otherwise in default of its obligations under this document in respect of the Land or relevant part of the Land forming the subject of the request. For the avoidance of doubt, until all Public Benefits have been provided by the Developer under this document, it will be entirely at the City’s discretion as to what strata lots forming part of the Land this document is released and discharged from.
Release of this document. (a) If the Council is satisfied that the Developer has provided all Public Benefits and otherwise complied with this document including expiry of the Post Completion Liability Period and rectification of any Defects notified during that periodthen the Council must promptly do all things reasonably required to remove this document from the certificate of title to the Land.

  • Modification of this Agreement This Agreement may not be modified, nor may compliance with any of its terms be waived, except as noted in Section 11.1, “Notices to Parties,” regarding change in personnel or place, and except by written instrument executed and approved in the same manner as this Agreement. Contractor shall cooperate with Department to submit to the Director of CMD any amendment, modification, supplement or change order that would result in a cumulative increase of the original amount of this Agreement by more than 20% (CMD Contract Modification Form).

  • Construction of this Amendment; Participation Agreement (a) This Amendment shall be interpreted to be consistent with, and to facilitate compliance with and reliance on, Rule 30e-3 under the 1940 Act and Rule 498A (including paragraph (j) thereof) under the 1933 Act and any interpretations of those Rules by the Securities and Exchange Commission, its staff, courts, or other appropriate legal authorities.
