Relief Work and Preservation of Rates. An employee temporarily assigned to a higher-rated position, shall receive the higher rate while occupying such position. ARTICLE Service Letters Notwithstanding the provisions of Article when a bona fide new job or position is to be established which cannot be properly placed in an existing classification by mutual agreement, Management will establish a classification and rate on a temporary basis. Written notification of the temporary rate and classification will be furnished to the Local Chairperson. The Company willnew rate and classification shall be considered temporary for a period of sixty (60) calendar days following the date of notification to the Local Chairperson. During this period (but not thereafter), the Local Chairperson may request the Railway to negotiate the rate for the classification. The negotiated rate, if higher than the rate, shall be applied retroactively to the date of the establishment of the temporary classification and rate, except as otherwise mutually agreed. If no request has been made by the Union to negotiate the rate within the sixty (60) calendar day period, or if no grievance is filed within sixty (60) days from the date of employmentnotification to the Union or upon completion of negotiations, all service cards as the case may be, the temporary classification and letters rate shall become a part of the wage scale. If the Railway and the Union are unable to agree on a classification, and rate for the new job, the disputed rate and/or classification may be treated as a grievance. The grievance may be taken up for inspection by at Step No. of the Companygrievance procedure, except for those addressed and if it is not resolved, it may be referred to or issued by the Company.
