Remedial Design Costs Shortfalls and Excesses. Because the amount of funds deposited by Atlantic Richfield into the Leviathan Mine Environmental Remediation Trust in any calendar year during Remedial Design will depend on the Remedial Design Cost Estimate for that year, it is possible that the funds may be either more than or less than sufficient to cover Atlantic Richfield’s obligations for Remedial Design Costs paid in that year. Such shortfalls and excesses shall be addressed as follows, subject to the same rights to dispute or withhold payments that are set forth in Sections V.A.7 and V.A.8 of this Agreement:

  • Start-Up Costs 4.1.1 The Government of Ontario will provide:

  • Assistance expenses The Parties shall waive all claims on each other for the reimbursement of expenses incurred in accordance with this Chapter, except, as appropriate, for expenses related to experts and witnesses and to interpreters and translators who are not public officials.

  • COSTS DISTRIBUTED THROUGH COUNTYWIDE COST ALLOCATIONS The indirect overhead and support service costs listed in the Summary Schedule (attached) are formally approved as actual costs for fiscal year 2020-21, and as estimated costs for fiscal year 2022-23 on a “fixed with carry-forward” basis. These costs may be included as part of the county departments’ costs indicated effective July 1, 2022, for further allocation to federal grants and contracts performed by the respective county departments.
