Remedies and Responsibilities. The Receiving Party acknowledges that the Disclosing Party has the right to take all reasonable steps to protect the Disclosing Party’s Confidential Information, including without limitation seeking injunctive relief and/or any other remedies that may be available at law or in equity, all of which remedies shall be cumulative and in addition to any rights and remedies available by contract, law, rule, regulation or order. Any requirements for a bond in connection with any such injunctive or other equitable relief are hereby waived by both parties.
Remedies and Responsibilities. All such remedies of the Authority with regard to environmental requirements as set forth herein shall be deemed cumulative in nature and shall survive termination of this Agreement. Airline shall be liable for, and hereby expressly assumes all responsibility for all citations, fines, environmental controls and monitoring, clean-up and disposal, restoration and corrective measures resulting from or in any way connected with the improper use, handling, storage or disposal of all pollutants or contaminated materials, as same are defined by law, in connection with Airline’s operations at the Airport by Airline or by Airline's employees, invitees, suppliers or service or providers of materials, regardless of whether or not a default notice has been issued and notwithstanding any other obligations imposed upon Airline pursuant to the terms of this Agreement.
Remedies and Responsibilities. The Grantee acknowledges and agrees, that AGRA may exercise its right to terminate or apply restrictions to this Agreement upon the occurrence of any transaction involving Grant Funds, that contravenes the provisions under this clause (any such transaction, an “Unauthorized Transaction”), and that the Grantee shall bear the sole and ultimate responsibility, financial and otherwise, for any losses resulting from any such transaction referred to above and shall reimburse AGRA for the amount of any losses or gains resulting from Unauthorized Transactions.
Remedies and Responsibilities. For each Program, the Grantee acknowledges and agrees, and shall cause the Principal Recipient and each of its Sub-recipients to acknowledge and agree, that the Global Fund may exercise its right to terminate or apply restrictions to the relevant Grant Agreement upon the occurrence of any transaction conducted by the Principal Recipient or any of its Sub-recipients involving Grant Funds that contravenes the provisions of this Article, and that the Grantee shall bear sole and ultimate responsibility, financial and otherwise, for any losses resulting from any such transaction referred to above and shall reimburse the Global Fund for the amount of any losses or gains resulting therefrom.
