(1) No failure on the part of the Lender to exercise, and no delay in exercising, any right under this Agreement will operate as a waiver thereof, nor will any single or partial exercise of any right under this Agreement preclude any other or further exercise thereof or of the exercise of any other right. The rights and remedies in this Agreement provided are cumulative and not exclusive of any rights or remedies provided by law. Any waiver or consent given by the Lender under this Agreement shall be in writing and may be given subject to such conditions as the Lender may impose. Any waiver or consent shall be effective only in the instance and for the purpose for which it is given. Any provision of this Agreement may be amended only if the Borrower and the Lender so agree in writing.
