Remedies Waivers and Amendments. 9.1 No failure on the part of a Lender to exercise, and no delay on its part in exercising, any right or remedy under this Agreement will operate as a waiver thereof, nor will any single or partial exercise of any right or remedy preclude any other or further exercise of that or any other right or remedy. The rights and remedies provided in this Agreement are cumulative and not exclusive of any other rights or remedies (whether provided by law or otherwise). 9.2 Any provision of this Agreement may be amended or waived only with the written agreement of each Party.

Remedies Waivers and Amendments. 17.1 No failure to exercise, nor any delay in exercising, on the part of any Combined Finance Party, any right or remedy under this Agreement shall operate as a waiver, nor shall any single or partial exercise of any right or remedy prevent any further or other exercise or the exercise of any other right or remedy.
