Replacement under Warranty. If a copier does not perform to manufacturer’s specifications during the warranty period, the OEM shall replace the unit(s) with a new copier of the same model. When a machine has reoccurring problems that cannot be corrected after multiple service calls and impairs the normal use of the machine, it should be replaced.
Replacement under Warranty. OCV agrees to replace or credit Allin for defective Equipment provided that (a) OCV is promptly notified in writing or e-mail upon discovery by Allin that such Equipment failed to conform to this Agreement with a detailed explanation of any alleged deficiencies and such notification occurs during the applicable warranty period, (b) such Equipment is returned to OCV, F.O.B. OCV’s plant from which the Equipment were shipped, and (c) OCV’s examination of such Equipment shall disclose that such alleged deficiencies actually exist and were not caused by accident, misuse, neglect, alteration, improper installation, unauthorized repair or improper testing. If such Equipment fails to conform to the warranty, OCV shall reimburse Allin for the transportation charges paid by Allin for such Equipment. If OCV elects to replace such Equipment, OCV shall have a reasonable time to replace such Equipment. Such replacement or credit shall constitute fulfillment of all liability of OCV to Allin whether based in contract, tort, indemnity, statutory provision or otherwise.
Replacement under Warranty. 16.1.10.1 Any unit or component, which fails during the installation/ warranty period, shall be replaced by the Contractor at no cost for Etisalat.
