During the Warranty Period. Xxxxx shall (i), at its option, either credit (in whole or in part) the Purchase Price of the defective Hardware Products, or repair or replace the defective (components of the) Hardware Products; or (ii) use commercially reasonable efforts to correct any reproducible nonconformity in the Software Products or, if Xxxxx is unable to correct such nonconformity, Xxxxx refund to Client the fees actually paid by Client to Xxxxx for the affected Software Products, in which case Client’s right to use such Software Products will terminate. Xxxxx shall re- perform, in a conforming manner, any nonconforming Services that are reported to Xxxxx by Client in writing within sixty (60) days after the date of completion of such Services.

During the Warranty Period upon receipt from Owner of notice of a failure of any of the Work to satisfy any Subcontractor warranty, representation, covenant, guarantee or obligation, Contractor shall be responsible for enforcing in the name of and on behalf of Owner, if so directed, or performing any such representation, warranty, covenant, guarantee or obligation, in addition to Contractor’s other obligations hereunder. Owner’s rights under this Section 11.3.2 shall commence at the time such representation, warranty, guarantee or obligation is furnished and shall continue until the expiration of Contractor’s Warranty (including extensions for redone Work). Until such expiration: the cost of any Equipment and Materials, labor (including re-engineering) or shipping shall be the responsibility of Contractor if such cost is covered by a Contractor warranty, and Contractor shall be required to replace or repair defective or damaged Equipment and Materials or workmanship furnished by Subcontractors in accordance with the procedures set forth in Section 11.1.3.
During the Warranty Period. Contractor shall keep a log of all faults and defects, and of any adjustments and changes made in order to remedy such faults and defects. Contractor shall enter, track and manage this log in the MMIS system. Contractor shall submit to Owner a report of warranty work performed during preceding week. Contractor shall track defects and submit a monthly report including all failures and defective items with running totals on a monthly and cumulative basis.
During the Warranty Period the Supplier shall bear full responsibility and undertakes to remedy and fully compensate ISR, at its own expense for any and all damage or loss to the Goods due to faults such as, but not limited to, faulty design, faulty workmanship, faulty dismantling for sea and land conveyance, faulty materials or components, and other faults in the accepted Goods whether made by the Supplier or any of the Supplier’s sub-contractors, and whether arising or negligent production. The Supplier shall then immediately and without delay replace the damaged Goods to the satisfaction of ISR and all costs related to such replacement, including, but not limited to, costs related to transportation, dismounting and mounting, etc. shall be borne by Supplier.
During the Warranty Period. Escuder undertakes, in the terms set forth in this Clause, upon written request of the Purchaser, to replace or repair at its own costs, the Products or of any of its parts or components, which are proved by the Purchaser to have a Defect.
During the Warranty Period. Precis shall at its expense and sole discretion, repair, replace or correct defective Equipment. Precis' obligations hereunder shall arise only if Precis' examination of the equipment in question discloses that claimed defect was not caused by any misuse, neglect, or any act of God, accident, fire or other hazard. Such repair, replacement or correction shall include labor and materials. Customer will be responsible for shipment of equipment one way to designated repair site.
