Reports of Violations. No employee shall be dismissed, disciplined, penalized, or intimidated as a result of a genuine report of pollution, WorkSafe, harassment, or other violations or alleged violations by the Employer. It is agreed the Union shall advise the Employer, without retaliation, using the appropriate policies and procedures, of any violations prior to reporting any alleged violation the Union shall afford the Employer reasonable opportunity to address the violation.

Reports of Violations. (a) The report of any violation of these regulations may be directed to the United States Attorney for the judicial district in which the violation occurs.

The testing party shall also repeat the sampling and analysis and submit the results of the repeat analysis to the other party within 30 days after becoming aware of the violation. However, we believe putting the commission in the position of “finding” a breach of the contract rather than a court doing so is problematic. The only reason we included language permitting the City to “find a violation” in the first sentence is because the City is under a regulatory obligation to enforce its sewer use ordinances, and, in that capacity, the City is placed in a position of “finding” violations. It is our preference that the language remain as shown in this version for those reasons.
