Common use of Representation When Reprimanded Clause in Contracts

Representation When Reprimanded. An employee shall be entitled, not required, to have present an Association representative while being reprimanded, warned or disciplined for any infraction of rules or delinquency in performance outside of the annual evaluation. When a request for such representation is made, no disciplinary action shall be taken with respect to the employee until such Association representation is present. When the presence of such Association representative is so requested, it is agreed that said representative shall be made available as soon as practical, but in all events within one (1) working day after the request is made. All information forming the basis for disciplinary action will be made available to the employee.
