Representations and Warranties Continue. In connection with this Modification and for purposes of making the representations and warranties in this Section, each Credit Party has reviewed each of the representations and warranties of such Credit Party in the Loan Documents. All such representations and warranties (taking this Modification into account), are complete and correct as of the date hereof, will continue to be complete and correct as of the Closing, and will survive the Closing.

Representations and Warranties Continue. The representations, warranties and covenants of the Seller set forth in Section 3.2 with respect to each Lease and the related Lease Receivable and Equipment conveyed by it shall continue so long as such Lease remains outstanding or until repurchased or substituted for pursuant to Article 6. The Seller shall be deemed to make such representations, warranties and covenants as to each Substitute Lease, and the related Lease Receivables and Equipment at the time of Substitution. Upon discovery by the Seller or the Transferor that any such representation or warranty was incorrect as of the time made, the party making such discovery shall give prompt notice to the other, the Servicer and the Trustee.
