RESPONSIBILITIES OF THE AGENCY AND OF CONTRACTOR. 3.1 DUTIES OF THE AGENCY: The AGENCY, without cost to CONTRACTOR, will provide all pertinent information necessary for CONTRACTOR’s performance of its obligations under this Agreement that is reasonably available to the AGENCY unless otherwise specified in the Scope of Work, in which case the CONTRACTOR is to acquire such information. The AGENCY does not guarantee or ensure the accuracy of any reports, information, and/or data so provided. To the extent that any reports, information, and/or other data so provided was supplied to the AGENCY by persons who are not employees of the AGENCY, any liability resulting from inaccuracies and/or omissions contained in said information shall be limited to liability on behalf of the party who prepared the information for the AGENCY.
