Unless the District and Architect agree that a hazardous materials consultant shall be a Consultant of the Architect, the District shall furnish the services of a hazardous material consultant or other consultants when such services are requested in writing by Architect and deemed necessary by the District or are requested by the District. These services shall include: asbestos and lead paint survey; abatement documentation; and specifications related to said matters, which are to be incorporated into bid documents prepared by Architect. If the hazardous materials consultant is furnished by the District and is not a Consultant of the Architect, the specifications shall include a note to the effect that the hazardous materials consultant’s specifications are included in the Architect’s bid documents for the District’s convenience and have not been prepared or reviewed by the Architect. The note shall also direct questions about the hazardous materials consultant’s specifications related to asbestos and lead paint survey and/or abatement documentation to the preparer of the hazardous materials consultant’s specifications.

The DISTRICT shall furnish the services of a hazardous material consultant or other consultants when such services are requested in writing by ARCHITECT and deemed necessary by the DISTRICT or are requested by the DISTRICT. The ARCHITECT shall be entitled to rely upon the accuracy and completeness of services, information, surveys, and reports provided or furnished by the DISTRICT. The DISTRICT shall, in writing, advise the ARCHITECT if the DISTRICT becomes aware of any fault or defect in the Project, including any errors, omissions or inconsistencies in the ARCHITECT’S documents. Failure to provide such notice shall not relieve ARCHITECT of its responsibility therefore, if any. If required for the ARCHITECT’S services and so advised by the ARCHITECT, the DISTRICT shall furnish surveys to describe physical characteristics, legal limitations and utility locations for the Project site(s), and a written legal description of the Project site(s). The surveys and legal information shall include, as applicable, grades and lines of streets, alleys, pavements and adjoining property and structures; adjacent drainage; rights-of-way, restrictions, easements, encroachments, zoning, deed restrictions, boundaries and contours of the Project site(s); locations, dimensions and necessary data with respect to existing buildings, other improvements and trees; and information concerning available utility services and lines, both public and private, above and below grade, including inverts and depths. All the information on the survey shall be referenced to a Project benchmark for each Project site. If so advised by the ARCHITECT and unless otherwise provided in this Agreement, the DISTRICT shall furnish tests, inspections and reports required by law or the Contract Documents, such as structural, mechanical, and chemical tests, tests for air and water pollution, and hazardous materials. Unless the District and the Architect agree that a hazardous materials consultant shall be a Consultant of the Architect, the District shall furnish the services of a hazardous material consultant or other consultants when those services are requested in writing by Architect and deemed necessary by the District or are requested by the District. These services shall include: asbestos and lead paint survey; abatement documentation; and specifications related to these matters which are to be incorporated into bid documents prepared by Architect. If the hazardous materials consultant is furnished by the District and is not a Consultant of the Architect, the specifications shall indicate that the specifications prepared by District’s consultant relating to these matters, are included in the Architect’s bid documents for the District’s convenience and have not been prepared or reviewed by the Architect. 13.4. District personnel and/or its designated representatives shall coordinate with Architect as may be requested and beneficial for the coordination or management of work related to the Project.
13.5. The District shall timely provide to the Architect all relevant information in its possession regarding the Project that is necessary for performance of Architect’s Services.
13.6. The District shall pay all fees required by agencies having jurisdiction over the Project.

12.2 The District shall provide to the Construction Manager as complete information as is available to District regarding the District’s requirements for the Project.
12.3 The District shall retain design professional(s) whose services, duties and responsibilities shall be described in written agreement(s) between the District and design professional(s).
12.4 Unless the contract documents require that Contractor provide any of the following, the District shall, in a timely manner, and with Construction Manager’s assistance, secure, submit and pay for necessary approvals, easements, assessments, permits and charges required for the construction, use, or occupancy of permanent structures or for permanent changes in existing facilities, subject to Construction Manager’s and/or the design professional(s) duties to recommend or provide same.
12.5 The District, its representatives, and consultants shall communicate with the Contractor either directly or through the Construction Manager.
12.6 The District shall designate an officer, employee and/or other authorized representatives to act on the District’s behalf with respect to the Project. The District’s representative for the Project shall be available during working hours and as often as may be required to render decisions and to furnish information in a timely manner.
Responsibilities of the District. A. The DISTRICT’S Technical Support Manager is designated to serve as project coordinator and to do all things necessary to properly administer the terms and conditions of this Agreement. The responsibility of the DISTRICT’S Technical Support Manager shall include:
i) Examination of all reports, sketches, drawings, estimates, proposals, and other documents presented by CONSULTANT, and render in writing, decisions pertaining thereto within a reasonable time.
ii) Transmission of instructions, receipt of information, interpretation and definition of the DISTRICT’S policies and decisions with respect to design, materials, and other matters pertinent to the work covered by this Agreement.
iii) Review for approval or rejection all CONSULTANT’S documents and payment requests.
B. The DISTRICT shall, upon request, furnish CONSULTANT with all existing data, plans, studies, and other information in the DISTRICT’S possession which may be useful in connection with the work of this Project, all of which shall be and remain the property of the DISTRICT and shall be returned to the DISTRICT’S Technical Support Manager upon completion of the services to be performed by CONSULTANT.
C. The DISTRICT’S Technical Support Manager shall conduct periodic reviews of the work of CONSULTANT necessary for the completion of CONSULTANT’S services during the period of this Agreement, and may make other DISTRICT personnel available, where required and necessary to assist CONSULTANT. The availability and necessity of said personnel to assist CONSULTANT shall be determined solely within the discretion of the DISTRICT.
D. The DISTRICT shall not provide any services to CONSULTANT in connection with any claim brought on behalf of or against CONSULTANT.

2. In the case of an extended absence (2 weeks or more) of a school counselor, psychologist, social worker or occupational therapist, the District will make every reasonable effort to provide a substitute to complete the necessary duties of the job.

12.7. The District shall designate an officer, employee and/or other authorized representatives to act on the District’s behalf with respect to the Project. The District’s representative for the Project shall be available during working hours and as often as may be required to render decisions and to furnish information in a timely manner.

The District will make available District campuses as relocation centers for its Head Start Centers in case of an emergency which requires the Head Start Program to close its Head Start Centers.
