Retours et ajustements. (a) Xx xxxxxxxx comprend que, dans le cadre de toute transaction associée aux comptes- cartes de crédit, s’il : (i) accepte le retour de tout produit ; (ii) permet la résiliation ou l’annulation de tout service ; ou (iii) permet l’ajustement du prix de tout produit ou service, xx xxxxxxxx ne procédera pas à un remboursement en espèces, mais produira plutôt une note de crédit qui sera immédiatement appliquée au compte-carte de crédit du titulaire, et remettra au titulaire de carte une copie exacte et complète d’une telle note de crédit au moment du remboursement ou de l’ajustement. Sur toute note de crédit, xx xxxxxxxx doit inclure une brève description des produits retournés, des services résiliés ou annulés ou bien du remboursement ou de l’ajustement accordé, en plus de la date et du montant du crédit et de tout autre détail suffisant à identifier la transaction. Le montant d’une note de crédit ne peut pas dépasser le montant de la transaction initiale, tel qu’il apparaît sur la facture de vente. La note de crédit doit indiquer le montant complet du remboursement ou de l’ajustement. Xx xxxxxxxx peut traiter une note de crédit pour un titulaire de carte seulement s’il a procédé à la transaction d’achat initiale en question avec un tel titulaire. Xx xxxxxxxx doit immédiatement soumettre une copie électronique de la note de crédit à Flexiti au moyen de l’application du xxxxxxxx. (b) Si xx xxxxxxxx : (i) accepte le retour de tout produit ; ou (ii) permet la résiliation ou l’annulation de tout service dans les trente (30) jours suivant la transaction de crédit pour les produits ou services, xx xxxxxxxx recevra le remboursement du TEM payé pour la transaction de crédit. (c) Si xx xxxxxxxx permet tout ajustement de prix dans les trente (30) jours suivant la transaction de crédit complétée pour les produits ou services, il recevra le remboursement de la portion du TEM exigible s’appliquant à la différence entre le prix initial et le prix ajusté des produits ou services. (d) Xx xxxxxxxx ne recevra aucun remboursement du TEM, que ce soit en tout ou en partie, s’il : (i) accepte le retour de tout produit ; (ii) permet la résiliation ou l’annulation de tout service ; ou (iii) permet l’ajustement du prix de tout produit ou service plus de trente (30) jours après la date de la transaction de crédit pour les produits ou services.

  • Trunk Group Architecture and Traffic Routing 5.2.1 The Parties shall jointly establish Access Toll Connecting Trunks between CLEC and CBT by which they will jointly provide Tandem-transported Switched Exchange Access Services to Interexchange Carriers to enable such Interexchange Carriers to originate and terminate traffic from and to CLEC's Customers. 5.2.2 Access Toll Connecting Trunks shall be used solely for the transmission and routing of Exchange Access and non-translated Toll Free traffic (e.g., 800/888) to allow CLEC’s Customers to connect to or be connected to the interexchange trunks of any Interexchange Carrier that is connected to the CBT access Tandem. 5.2.3 The Access Toll Connecting Trunks shall be one-way or two-way trunks, as mutually agreed, connecting an End Office Switch that CLEC utilizes to provide Telephone Exchange Service and Switched Exchange Access Service in the given LATA to an access Tandem Switch CBT utilizes to provide Exchange Access in the LATA.

  • Annual Evaluations The purpose of the annual evaluation is to assess and communicate the nature and extent of an employee's performance of assigned duties consistent with the criteria specified below in this Policy.   • Minimum Site Requirements for TIPS Sales (when applicable to TIPS Sale). Cleanup: When performing work on site at a TIPS Member’s property, Vendor shall clean up and remove all debris and rubbish resulting from their work as required or directed by the TIPS Member or as agreed by the parties. Upon completion of work, the premises shall be left in good repair and an orderly, neat, clean and unobstructed condition. Preparation: Vendor shall not begin a project for which a TIPS Member has not prepared the site, unless Vendor does the preparation work at no cost, or until TIPS Member includes the cost of site preparation in the TIPS Sale Site preparation includes, but is not limited to: moving furniture, installing wiring for networks or power, and similar pre‐installation requirements. Registered Sex Offender Restrictions: For work to be performed at schools, Vendor agrees that no employee of Vendor or a subcontractor who has been adjudicated to be a registered sex offender will perform work at any time when students are, or reasonably expected to be, present unless otherwise agreed by the TIPS Member. Vendor agrees that a violation of this condition shall be considered a material breach and may result in the cancellation of the TIPS Sale at the TIPS Member’s discretion. Vendor must identify any additional costs associated with compliance of this term. If no costs are specified, compliance with this term will be provided at no additional charge. Safety Measures: Vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage. Smoking: Persons working under Agreement shall adhere to the TIPS Member’s or local smoking statutes, codes, ordinances, and policies.

  • SALARY SACRIFICE ARRANGEMENTS 34.1 Employees covered by this Agreement will have access to salary sacrifice arrangements in addition to the compulsory arrangement detailed above. The requirements of any such arrangements shall ensure that: (a) Accessing a salary sacrifice arrangement is a voluntary decision to be made by the individual Employee. (b) An Employee wishing to enter into a salary sacrifice arrangement will be required to notify their Employer in writing of the intention to do so and have sought expert advice in relation to entering into such an arrangement. (c) The Employer shall meet the cost of implementing the administrative and payroll arrangements necessary for the introduction of salary sacrifice to the Employees under the Agreement. (d) The co-contribution of superannuation payments referred to herein shall be made by way of salary sacrifice arrangements.

  • Order to Stop Work The Chief Procurement Officer, may, by written order to Contractor at any time, and without notice to any surety, require Contractor to stop all or any part of the work called for by this contract. This order shall be for a specified period not exceeding 90 days after the order is delivered to Contractor, unless the parties agree to any further period. Any such order shall be identified specifically as a stop work order issued pursuant to this clause. Upon receipt of such an order, Contractor shall forthwith comply with its terms and take all reasonable steps to minimize the occurrence of costs allocable to the work covered by the order during the period of work stoppage. Before the stop work order expires, or within any further period to which the parties shall have agreed, the Chief Procurement Officer shall either: i. cancel the stop work order; or, ii. terminate the work covered by such order as provided in the Termination for Default clause or the Termination for Convenience clause of this contract.
