Common use of Return of City Property Clause in Contracts

Return of City Property. In the event an employee leaves City service without returning all City-issued property, the City may deduct from the employee's final paycheck such amount as will fairly compensate the City for the value of the unreturned property. Such deduction is not meant to waive any other rights the City may have regarding obtaining the return of City property or seeking damages for the failure to return such property. This provision does not apply to the Employee Purchase Program (EPP) for computer systems, which is covered under separate agreement between the employee and the City, except that an employee owing the City money as a result of his/her participation in the EPP shall pay to the City the full amount due prior to his/her separation from the City or the City, at its discretion, may deduct the amount due from the employee's final paycheck.

Return of City Property. The City reserves the right to pursue all legal remedies, both criminal and civil, to recover the unreturned property. Such deduction is not meant to waive any other rights , the City may have regarding obtaining value of the return of City property unreturned property, or seeking damages for the failure to return such propertyboth.
