Return of Grant. 5.1 Pursuant to the terms of the Network Membership Agreement, should any part of the Grant remain unspent after acceptance of the Final Report, the Member shall return such unspent monies to Start Network, together with any interest accrued by the Member, within 14 days of Start Network’s acceptance of the Final Report, unless Start Network agrees otherwise in writing.
Return of Grant. If (i) the Authority, as a result of a breach by the Company under the terms of the XXX Xxxxx Agreement, does not disburse the Grant or any portion thereof to the Company by the outside dates permitted for such disbursement in accordance with the terms of the XXX Xxxxx Agreement; or (ii) the Authority has determined in accordance with the requirements of the XXX Xxxxx Agreement that the Company is unlikely to have completed the Facility or is unlikely or unable to have substantially injected the full Capital Investment by the Completion Date and thereafter recovers the Grant or any portion thereof from the Company as permitted by the terms of the XXX Xxxxx Agreement, then the Authority will promptly return to the City the Grant or any portion thereof remaining undisbursed by the Authority or recovered back by the Authority from the Company. In the event of breach of the XXX Xxxxx Agreement by the Company, the Authority will, upon request by the City, assign to the City its rights under the XXX Xxxxx Agreement to recover the Grant or portions thereof directly from the Company.
Return of Grant. In the event the Program is cancelled or does not conform to the Application Form or the terms and conditions of this Agreement or the Final Report is falsified or does not accurately reflect the Program, LTI Korea reserves the right, in addition to any other remedies LTI Korea may have under this Agreement, at law or in equity, to demand Recipient to return any and all Overseas Translation Workshop Grant awarded to Recipient by LTI Korea and Recipient agrees to comply with LTI Korea's demand. ln the event the retum of any and all Overseas Translation Workshop Grant demanded hereunder is not received within ten (10) days after LTI Korea sends a notice of demand to Recipient, Recipient shall be subject to a late payment penalty of five percent (5%) of the unpaid amount due for each month outstanding until paid, beginning from the date overdue.
