Common use of Return of Incumbent Employee to Position Clause in Contracts

Return of Incumbent Employee to Position. Any position occupied by a Temporary Employee, or Permanent Employee on a temporary basis, shall be assumed by the incumbent of the permanent position upon the incumbent’s scheduled return to duty. Notwithstanding the above, with the consent of the Employer, in exceptional circumstances, the incumbent may resume their position before their scheduled return date, by providing the Employer with at least fourteen (14) days advance notice of their intended return date.
