Return of Performance Bank Guarantee. 3.4.1 Subject to Article 3.3, SECI shall return / release the Performance Bank Guarantee immediately after the successful Commissioning of the Project after taking into account any liquidated damages / penalties due to delays in commissioning as per provisions stipulated in this Agreement.
3.4.2 The return / release of the Performance Bank Guarantee shall be without prejudice to other rights of SECI under this Agreement.
Return of Performance Bank Guarantee. Payment on Order Instrument
3.4.1 Subject to Article 3.3, SECI shall return / release the Performance Bank Guarantee/ Payment on Order Instrument immediately after the successful Commissioning of the Project after taking into account any liquidated damages / penalties due to delays in commissioning as per provisions stipulated in this Agreement.
3.4.2 The return / release of the Performance Bank Guarantee/ Payment on Order Instrument shall be without prejudice to other rights of SECI under this Agreement.
Return of Performance Bank Guarantee. Payment on Order Instrument
3.3.1 Subject to Article 3.2, SECI shall return / release the Performance Bank Guarantee/ Payment on Order Instrument within 30 days after the successful commencement of Power supply from the Project after taking into account any liquidated damages / penalties due to delays in commencement of power supply beyond SCSD as per provisions stipulated in this Agreement. PBG may be returned on pro-rata basis subsequent to commencement of supply from part-capacity of the Project, based on the request by the SPD.
3.3.2 The return / release of the Performance Bank Guarantee/ Payment on Order Instrument shall be without prejudice to other rights of SECI under this Agreement.
Return of Performance Bank Guarantee. KSPDCL shall return/release the Performance Bank Guarantee three (3) months after Commercial Operation Date without prejudice to other rights of KSPDCL under this Agreement.
6.7 Transmission Charges and Scheduling Charges
Return of Performance Bank Guarantee. 3.4.1 Subject to Article 3.3, NTPC shall return / release the Performance Bank Guarantee three (03) months after Commercial Operation Declaration of the Project after adjustment any liquidated damages / penalties due to delays in commissioning as per provisions stipulated in this Agreement
3.4.2 The return / release of the Performance Bank Guarantee shall be without prejudice to other rights of NTPC under this Agreement.
Return of Performance Bank Guarantee. 3.4.1 Subject to Article 3.3, UPNEDA shall return / release the Performance Bank Guarantee within three (3) months after the Commissioning Date.
3.4.2 The return / release of the Performance Bank Guarantee shall be without prejudice to other rights of UPNEDA under this Agreement.
Return of Performance Bank Guarantee. 3.4.1 Subject to Article 3.3, NVVN shall return / release the Performance Bank Guarantee three (3) months after the Commercial Operation Date.
Return of Performance Bank Guarantee. APGCL shall return/release the Performance Bank Guarantee three (3) months after Commercial Operation Date without prejudice to other rights of APGCL under this Agreement
Return of Performance Bank Guarantee. 3.4.1 Subject to Article 3.3, UPNEDA shall return / release the Performance Bank Guarantee /POI within forty five days (45) after the Commissioning date after taking into account any liquidated damages due to delays in commissioning. In case of part commissioning, PBG, corresponding to the part capacity commissioned, will be released within 45 days of such part-commissioning
3.4.2 The return / release of the Performance Bank Guarantee shall be without prejudice to other rights of UPNEDA under this Agreement.
Return of Performance Bank Guarantee. POI
3.4.1 Subject to Article 3.3, MSPDCL shall return / release the Performance Bank Guarantee/POI immediately after the successful Commissioning of the Project after taking into account any liquidated damages / penalties due to delays in commissioning as per provisions stipulated in this Agreement.
3.4.2 The return / release of the Performance Bank Guarantee/POI shall be without prejudice to other rights of MSPDCL under this Agreement.
