Common use of Review of Using Agency’s Program Clause in Contracts

Review of Using Agency’s Program. The Design Builder shall review the Using Agency’s Program with the Owner to confirm its understanding of the Owner’s requirements. The Design Builder shall reconcile the Using Agency’s Program with its initial Statement of Probable Construction Cost and assist the Owner in refining or making clarifications to the Owner’s requirements for the Project. If extensive changes from the Using Agency’s Program are required, the Design Builder’s compensation and schedule may be equitably adjusted. In its reconciliation of the Using Agency’s Program, the Design Builder shall take into consideration the value of alternative materials, building systems, equipment, maintenance costs, budget, and other considerations in its design.
