Common use of Right of redress Clause in Contracts

Right of redress. 1. Any individual shall have the right to effective administrative and judicial redress in case any of his or her rights referred to in this Agreement have been violated. 2. Any individual who has suffered damage as a result of an unlawful processing operation or of any act incompatible with rights referred to in this Agreement shall have the right to apply for effective remedies, which may include compensation from Australia. 3. The rights referred to in paragraphs 1 and 2 shall be afforded to individuals regardless of their nationality or country of origin, place of residence or physical presence in Australia.
