Right to Intervene. In the event that any claim, demand, suit or other proceeding is instituted or threatened against the Purchaser relating to this Agreement, the Assets or the Assumed Liabilities, the Seller shall have the right, at its discretion and expense, to intervene in such matter, and the Purchaser hereby agrees to give prompt and prior notice thereof to the Seller and consents to such intervention.
Right to Intervene and participate in the procedure
(a) in relation to cases which concern a failure to fulfil obligations under the Treaties, where the United Kingdom was subject to the same obligations before the end of the transition period, and where such cases are brought before the Court of Justice of the European Union in accordance with Articles 258 TFEU before the end of the period referred to in Article 87(1) or, as the case may be, until the moment, after the end of that period, at which the last judgment or order rendered by the Court of Justice of the European Union on the basis of Article 87(1) has become final;
(b) in relation to cases which concern acts or provisions of Union law which were applicable before the end of the transition period to and in the United Kingdom and which are brought before Court of Justice of the European Union in accordance with Article 267 TFEU before the end of the period referred to in Article 87(1) or, as the case may be, until the moment, after the end of that period, at which the last judgment or order rendered by the Court of Justice on the basis of Article 87
Right to Intervene. In the event that any claim, protest, suit or other proceeding is instituted against Purchaser under this Agreement, Seller shall have the right, at its discretion and expense, to intervene in such litigation, and Purchaser hereby consents to such intervention.
Right to Intervene. In the event that any litigation is instituted against either party under this Agreement, the other party shall have the right at its sole discretion to intervene in such litigation, and the parties do hereby consent to such intervention.
Right to Intervene. From and after the date hereof, in the event that any claim, protest, suit or other proceeding is instituted against Purchaser pursuant to or in connection with this Agreement, Seller shall have the right, at its discretion and expense, to intervene in such matter. The right of Seller to intervene pursuant to this Section 9.11 shall survive the Closing.
Right to Intervene. From and after the date hereof, in the event that any claim, protest, suit or other proceedings is instituted against Purchaser pursuant to or in connection with this Agreement, Seller shall have the right, at its discretion and expense, to intervene in such matter. The right of Seller to intervene pursuant to this Section 8.9 shall survive the Closing. From and after the date hereof, in the event that any claim, protest, suit or other proceedings is instituted against Seller pursuant to or in connection with this Agreement, Purchaser shall have the right, at its discretion and expense, to intervene in such matter. The right of Purchaser to intervene pursuant to this Section 8.9 shall survive the Closing.
Right to Intervene. Nothing in this Agreement shall prohibit any Party from intervening in any regulatory proceeding relating to the Project or the Other Facilities and taking any position in any such proceeding that it deems appropriate.
Right to Intervene. In the event that any claim, protest, suit or other proceeding is instituted or threatened against Purchaser or Seller relating to this Agreement or the Loans, other Assets or liabilities transferred to or assumed by Purchaser hereunder, Seller and Purchaser shall have the right, at their discretion and expense, to intervene in such matter, and each party hereby agrees to give prompt and prior notice thereof to the other party and consents to such intervention.
Right to Intervene. The Highlands staff is authorized to close the bar down if alcohol consumption becomes a dangerous situation and/or is the cause of damage to the property. Additionally, The Highlands may ask guests for identification to verify age and reserves the right to ask the entire party to leave if (1) a minor is consuming alcohol; (2) an adult is providing alcohol to a minor; or (3) a guest or guests appears intoxicated and refuses to leave the Premises.
Right to Intervene. Notwithstanding anything else in this Agreement, the Attorney General maintains the right to intervene in any of the Transferred Prosecutions and shall be responsible for any and all costs from such intervention.
