Right to Seek Modification a. Rite Aid may seek to modify the sections of this Agreement relating to web accessibility if Rite Aid reasonably believes that complying with those sections will fundamentally alter the nature of the services offered by xxxxxxx.xxx or result in an “undue burden” (i.e., significant difficulty or expense) within the meaning of 42 U.S.C. section 12182(iii) and 28 C.F.R. sections 36.104 and 36.303. In determining whether an action would result in an undue burden within the meaning of these authorities, factors to be considered include those set forth in 28 C.F.R. section 36.104, part III-4.3600 of the Technical Assistance Manual, and any other regulations/interpretative guidance issued by or on behalf of the United States Department of Justice.
Right to Seek Modification. 9.1. CVS may modify the schedules set forth in Sections 4 and 6 above if CVS reasonably concludes in good faith that unforeseen circumstances render compliance with these Sections impossible or impracticable.
Right to Seek Modification. 6.1 Target may seek to modify the schedules set forth in Section 3 above, if Target reasonably believes that compliance with the schedules will result in an “undue burden” within the meaning of 42 U.S.C. section 12182(iii) and 28 C.F.R. sections 36.104 and 36.303. Additionally, as set forth in Section 14, Target may also seek to modify these schedules as a result of Force Majeure.
Right to Seek Modification a. Pursuant to section 14 below, Rite Aid may seek to modify the schedule for installing Next Generation POS Devices, as set forth in sections 2 and 3 above, if Rite Aid reasonably believes that complying with that schedule will result in an “undue burden” within the meaning of 42 U.S.C. section 12182(iii) and 28 C.F.R. sections 36.104 and 36.303. Notwithstanding the foregoing, during each year of the Agreement, Rite Aid may defer installation of Next Generation POS Devices in up to one hundred Rite Aid Stores for up to six months upon written notification to the Organizations’ Counsel.
Right to Seek Modification. The Company shall agree to review the terms and conditions relating to any monetary benefits (on pro rata basis wherever applicable) available to the existing Debenture Holders in case the Central Government announces in future any modification / amendment / revision in the guidelines for the purpose of issue of Debentures by Public Limited Companies.
Right to Seek Modification. 7.1 Best Buy may seek to modify the schedules set forth in Section 3 above, if Best Buy reasonably believes that compliance with the schedules will result in an “undue burden”, as hereinafter defined, and may also, as set forth in Section 14, seek to modify these schedules as a result of Force Majeure.
