Rights of Members to Operate and Improve Separately Owned Facilities. The Members understand and agree that, notwithstanding the aforementioned joint use, the District shall have no responsibility for or control over the operation of the Clean Water Facility and the City shall have no responsibility for or control over the operation of the New Center or the Center Support Facilities. This Agreement is not intended to nor does it purport to affect, alter or control the operations by the City or the District of any of their properties or enterprises, including their respective portions of the Facilities.

  • Participating TO’s Interconnection Facilities The Participating TO shall design, procure, construct, install, own and/or control the Participating TO’s Interconnection Facilities described in Appendix A at the sole expense of the Interconnection Customer. Unless the Participating TO elects to fund the capital for the Participating TO’s Interconnection Facilities, they shall be solely funded by the Interconnection Customer.
