Risk Assessment to Determine Breach. An acquisition, access, use, or disclosure of PHI in a manner not permitted under HIPAA is presumed to be a Breach unless Business Associate demonstrates that there is a low probability that the PHI has been compromised based on a risk assessment. Business Associate shall develop and maintain policies and procedures for conducting a risk assessment in accordance with 45 C.F.R. §164.402(2). If Business Associate determines, after a risk assessment, that no Breach has occurred, Business Associate shall maintain documentation regarding the risk assessment in accordance with section 5.11 of this Agreement.
