Common use of Road Maintenance Clause in Contracts

Road Maintenance. 4.1 At the date of execution of this Agreement, the Xxxxx Xxxxxxxxxxxx xx Xxxxxx #000 has agreed to provide gravel road maintenance. The Developer makes no representations or warranties that such services will be provided indefinitely. 4.2 The Property Owner bears sole responsibility for all costs associated with the construction and maintenance of access (“the Approach”) to the Property from the roads constructed by the Developer, and for the installation of any culverts that may be required for such Approach, all in accordance and compliance with the municipal standards. The Developer has recommended that pre- and post- construction approval of the Xxxxx Xxxxxxxxxxxx xx Xxxxxx #000 xxxxxxx be obtained. Construction specifications include: i) Minimum of 1 meter inset from the property boundary, unless the Developer has expressly approved an Approach that is shared between properties; ii) Width of the Approach must be a minimum of 7 meters or as otherwise approved by the RM of Coteau, with surface crowning that facilitates appropriate drainage to existing ditch areas. 4.3 Each property must have an Approach, subject to the Developer approving a shared Approach as aforesaid. 4.4 The Approach surface is not included in the calculation of the building envelope. 4.5 No on-street parking is permitted. For each instance that the Property Owner or any of his guests or others of his invitees to his property breaches this paragraph, the Property Owner shall pay the sum of $5,000.00 to the Developer, it being acknowledged that such sum is a reasonable estimate of the minimum sum of the Developer's damages and losses arising from the time, expense and disruption that the Developer may incur and arising from the impact on the development itself, as a result of such on-street parking. Notwithstanding such estimate and minimum, the Developer shall not be restricted to enforcing collection of only such sum from the Property Owner, and, to the contrary, may pursue any further damages and losses that the Property Owner may incur as a result of such parking. 4.6 The Approach shall be gravelled. Dirt or grass approaches are not permitted. 4.7 The Property Owner is solely responsible for the maintenance and snow removal related to his Approach.
