Common use of Safety and Protection Clause in Contracts

Safety and Protection. 42.1 The Contractor shall be responsible for initiating, maintaining, and supervising all safety precautions and programs in connection with the Project. The Contractor shall take all necessary precautions for the safety of, and shall provide the necessary protection to prevent damage, injury, or loss to: 42.1.1 All employees on the Project and other persons who may be affected thereby. 42.1.2 All the work and all materials or equipment to be incorporated therein, whether in storage on or off the Project site; and 42.1.3 Other property at the site or adjacent thereto, including trees, shrubs, lawns, walks, pavements, roadways, structures, and utilities not designated for removal, relocation, or replacement in the course of construction. 42.2 The Contractor shall comply with all applicable laws, ordinances, rules, regulations, and orders of any public body having jurisdiction for the safety of persons or property or to protect them from damage, injury, or loss, and shall erect and maintain all necessary safeguards for such safety and protection. The Contractor shall notify owners of adjacent property and utilities when prosecution of the work may affect them. All damage, injury or loss to any property referred to in Sections 42.1.2 and 42.1.3 above, caused directly or indirectly, in whole or in part, by the Contractor, any subcontractor or consultant, or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, shall be remedied by the Contractor. The Contractor's duties and responsibilities for the safety and protection of the Project shall continue until such time as all the Project is completed, and the Project Manager has issued a notice to the Contractor that the Project is acceptable except as otherwise provided in Article 27,

All damage, injury injury, or loss to any property referred to in Sections 42.1.2 subsections 47.1.2 and 42.1.3 47.1.3 above, caused directly or indirectly, in whole or in part, by the Contractor, any subcontractor or consultant, Subcontractor or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, shall be repaired or remedied by the Contractor. The Contractor's ’s duties and responsibilities for the safety and protection of the Project Work shall continue until such time as all the Project Work is completed, completed and the Project Manager Consultant has issued a notice to the County and Contractor that the Project Work is acceptable except as otherwise provided in Article 27,30. 47.3 Contractor shall designate a responsible member of its organization at the Project site whose duty shall be the prevention of accidents. This person shall be Contractor’s superintendent unless otherwise designated in writing by Contractor to County.

All damage, injury injury, or loss to any property referred to in Sections 42.1.2 and 42.1.3 above, caused directly or indirectly, in whole or in part, by the Contractor, any subcontractor or consultant, or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, liable shall be remedied by the Contractor. The Contractor's duties and responsibilities for the safety and protection of the Project shall continue until such time as all the Project is completed, and the Project Manager has issued a notice to the Contractor that the Project is acceptable except as otherwise provided in Article 27,. 42.3 The Contractor shall designate a responsible member of its organization at the Project site whose duty shall be the prevention of accidents. This person shall be the Contractor's Designated Representative unless otherwise designated in writing by the Contractor to the City.
