Common use of Salary Protection and Downward Reclassification of Position Clause in Contracts

Salary Protection and Downward Reclassification of Position. (a) An employee shall not have his/her salary reduced by reason of: (1) a change in the classification of his/her position; or (2) placement into another position with a lower maximum salary; that is caused other than by the employee. That employee shall not receive negotiated salary increases until the salary of the employee's new classification equals or exceeds the salary which the employee is receiving. When the salary of the employee's new classification equals or exceeds the salary which the employee is receiving, the employee's salary will be implemented at the new classification. That employee shall receive the full negotiated salary increases for his/her new classification thereafter.
