Common use of Salary Protection and Downward Reclassification of Position Clause in Contracts

Salary Protection and Downward Reclassification of Position. ‌ (a) A team member shall not have their salary reduced by reason of a downward reclassification of position that is caused other than by the team member. (b) A downward reclassification of position occurs when: (1) there is a change in the classification of their position; or (2) a team member is placed into another position with a lower maximum salary, (c) Team members hired prior to May 17, 2005 will be grand-parented in the event of a downward reclassification of position. (d) Team members hired after May 17, 2005 will, in the event of a downward reclassification of position, be "red-circled" as follows: (1) That team member shall not receive negotiated salary increases until the salary of the team member's new classification equals or exceeds the salary, which the team member is receiving. (2) When the salary of the team member's new classification equals or exceeds the salary, which the team member is receiving, the team member's salary will be implemented at the maximum step of their new classification. (3) That team member shall receive the full negotiated salary increases for their new classification thereafter. (e) This article applies to changes in classifications or placements made pursuant to Article 13 -
