Common use of Salary Protection and Downward Reclassification of Position Clause in Contracts

Salary Protection and Downward Reclassification of Position. (a) When an employee's classification is changed or an employee is placed into a position with a lower maximum salary, through no fault of the employee, the following shall apply: (1) the employee shall not have his/her salary reduced; (2) the employee shall not receive any salary increases until the maximum salary of the lower classification equals or exceeds the employee's salary; (3) when the maximum salary of the lower classification equals or exceeds the employee's salary the employee shall receive the full negotiated salary increases of the new classification thereafter. (b) Such changes in classifications or placements made pursuant to Article 13 and/or 31.8 are covered by (a) above.
