Common use of Salary Protection Clause in Contracts

Salary Protection. Surplus employees and laid-off persons appointed to a lower-level position under this clause shall be remunerated as per the following provisions: (a) The employee’s rate of pay shall be unaffected and, for all intents and purposes, maintained at the rate of pay of the employee's substantive position. The employee shall obtain incremental increases until his salary has reached the maximum rate of the substantive position’s pay scale. (b) Reclassification of the position to a lower level shall take effect once the position becomes vacant.
