Common use of Sale or Closure of Store Clause in Contracts

Sale or Closure of Store. In the event of sale or closure of a store, part-time employees who have worked an average of twenty-eight (28) hours per week or more in the past thirteen (13) weeks shall be able to exercise their seniority in other stores of the Employer within the same contract area. In the event that the Employer closes a retail store resulting in employee(s) losing their employment, the Employer agrees to give the employee(s) first consideration based on continuous service with the Employer in British Columbia Bargaining Unit(s) for rehire within their previous classification, before hiring any new employees in other Bargaining Units within the province of British Columbia. Upon rehire within the same classification, an employee shall receive full credit for previous experience for the purpose of establishing their rate of pay. This Clause shall be effective for a maximum of six (6) months after store closure. It shall be the sole responsibility of the employee to keep in contact with the Employer to be aware of potential vacancies with the Company. The Employer shall not be obligated to contact the employee of any vacancies.
