SANCTIONS FOR NONCOMPLIANCE WITH THE AUTHORITY’S DBE PROGRAM REQUIREMENTS. Failure by the contractor to carry out the Authority’s DBE Program Requirements is a material breach of the contract, which may result in the termination of this contract or such other remedy, as the Authority deems appropriate, which may include, but is not limited to: (1) withholding monthly (or periodic payments); (2) assessing sanctions; (3) liqui- dated damages; and/or (4) disqualifying the contractor from future bidding as non-responsible. The willful making of false statements or providing incorrect information will be referred for appropriate legal action.

If legal remedies are deemed necessary, the Office of Diversity shall notify the Contractor of the findings and justifi- cation for the applied sanctions in writing. If the Contractor believes the sanction(s) is not just, the Contractor will be allowed a five-day appeal period from the time of the notification to submit a written appeal with supporting documents to the DBE Reconsideration Officer at 0000 X 0xx Xxxxxx, Xxxxxx, XX 00000 or via email at officeofdiversity@cap- xxxxx.xxx. The DBE Reconsideration Officer will evaluate documents and the Office of Diversity will inform the con- tractor of the decision within 10 days from the receipt of appeal.   • COMPLIANCE WITH THE CONTRACT WORK HOURS AND SAFETY STANDARDS ACT (1) Overtime requirements.
