Common use of Scheduled Maintenance/Emergencies Clause in Contracts

Scheduled Maintenance/Emergencies. HMH may conduct regular maintenance each night between midnight – 5 am EST to maintain the proper operation of the Hosting Environment and Services. Due to the system redundancies to the Hosting Environment, HMH can perform most maintenance without any service interruption. Any other non-emergency shutdown that requires the Hosting Environment to be unavailable will be scheduled in advance with notice to Customer of the interruption times. Customer acknowledges that emergency situations may arise in which no advance notice of service interruption or shutdown is possible.
