Salary Maintenance. (a) Entitlement to salary maintenance
(i) is a lower grade;
(ii) involves working fewer hours; and/or
(iii) removes eligibility for penalties, loadings and the like.
(b) Period of salary maintenance
(i) accepts another position within the salary maintenance period, and
(ii) is paid in the other position an amount equal to or greater than the role that was made redundant.
Salary Maintenance. Increases in salary to each Unit Member and step advances shall depend upon that Unit Member receiving a satisfactory evaluation, subject to the following conditions:
1. A “satisfactory evaluation” is a formal evaluation conducted pursuant to Article XI of this Agreement, which concludes with the following recommendation: “satisfactory.”
Salary Maintenance. (a) Entitlement to salary maintenance An Affected Employee who is successfully redeployed will be entitled to salary maintenance where the Affected Employee’s pay is reduced because the new role:
(i) is a lower grade;
(ii) involves working fewer hours; and/or
(iii) removes eligibility for penalties, loadings and the like.
(b) Period of salary maintenance Salary maintenance will be for a period of 52 weeks from the date the Affected Employee is redeployed except where the Affected Employee:
(i) accepts another position within the salary maintenance period, and
(ii) is paid in the other position an amount equal to or greater than the role that was made redundant.
Salary Maintenance movement between AGS and other parts of the Department
(1) This clause applies to an employee moving at approved classification level within the Department from AGS to another part of the Department.
(2) If the salary the employee was receiving immediately preceding the movement (the current salary) exceeds the maximum salary payable under Schedule 1 in this Agreement for the classification level at which the employee is moving (the maximum salary), the Secretary may treat the maximum salary as an amount not less than the employee’s current salary.
Salary Maintenance movement from another agency
(1) This clause applies to a person moving to the Department from another department or agency if the salary the person was receiving in the other department or agency immediately before the movement (the current salary) exceeds the maximum salary payable under this Agreement for the classification level to which the person is moving (the maximum salary).
(2) The Secretary may treat the maximum salary as an amount not less than the person’s current salary.
Salary Maintenance. (a) Entitlement to salary maintenance An Affected Doctor who is successfully redeployed will be entitled to salary maintenance where the Affected Doctor’s pay is reduced because the new role:
(i) is a lower grade;
(ii) involves working fewer hours; and/or
(iii) removes eligibility for penalties, loadings and the like.
(b) Period of salary maintenance Salary maintenance will be for a period of 52 weeks from the date the Affected Doctor is redeployed except where the Affected Doctor:
(i) accepts another position within the salary maintenance period, and
(ii) is paid in the other position an amount equal to or greater than the role that was made redundant.
Salary Maintenance. 9.1 The salary of an employee who is identified as surplus to requirements and who does not elect to accept voluntary retrenchment shall be maintained at the level prescribed for the nominal classification of that employee for at least two years from the date of formal notice that the employee is surplus to requirements. An individual review will take place of any excess staff who have been receiving salary maintenance for two years. No redeployee however, will have his/her salary maintenance ceased unless he/she has refused a reasonable opportunity for placement at their nominal level.
9.2 For the purposes of 9.1, salary maintenance will include normal incremental advancement through the former salary range and future wage adjustments awarded to the classification of the position the employee was occupying immediately before the position was declared surplus to requirements.
9.3 Maintenance of higher duties for surplus employees will be paid in accordance with the following:
Salary Maintenance. (a) An ongoing Employee who is redeployed, or an Employee with not less than 5 years continuous service who is redeployed, must be paid:
(i) on an ongoing basis, a salary not less than the Employee would have been paid in the Employee's position prior to the re-deployment, as adjusted from time to time in accordance with salary increases under this Agreement and adjusted to reflect each incremental step through the former classification on the anniversary of each increment; and
(ii) for a period of 12 months from the date of redeployment, a total emolument which is not less than the salary payable immediately prior to the date of transfer and the all purpose allowances paid to the ongoing Employee or Employee over the preceding 12 months.
(b) For the purposes of this clause "all purpose allowances" means any allowance (other than a higher duties allowance) which an ongoing Employee or Employee would have been entitled to be paid whilst on recreation leave and shift allowances paid to the ongoing Employee or Employee during the 12 months immediately preceding the day of transfer.
Salary Maintenance. 9.1 The salary of an employee who is identified as surplus to requirements and who does not elect to accept voluntary retrenchment shall be maintained at the level prescribed for the nominal classification of that employee for at least two years from the date of formal notice that the employee is surplus to requirements. 9.3 Maintenance of higher duties for surplus employees will be paid in accordance with the following:
(i) where, at date of redeployment, the redeployee is employed on short term higher duties (i.e. up to 6 months) the higher duties payment is to continue as income maintenance for the previously authorised higher duties period; or
(ii) where, at the date of redeployment, the redeployee is employed on long term higher duties the higher duties payment is to continue as income maintenance for 6 months. Except that where an employee has accrued a minimum of 12 months higher duties service in the previous 14 months, higher duties payment is to continue as income maintenance for 12 months.
Salary Maintenance. Any employee who wishes to maintain their contracted/rostered hours as a minimum and who is not given the opportunity to work their hours over a roster period will be salary maintained. By mutual agreement employees contracted hours will be renegotiated to be divisible by either 8 or 12 hours (10 hours for night duty shifts).
